📢 MahaRERA's New Banking Requirements for Developers: A Milestone in Financial Transparency and Protection for Homebuyers Starting July 1, 2024, the Maharashtra Real Estate Regulatory Authority (MahaRERA) mandates real estate developers to maintain three separate bank accounts for every project. This crucial decision aims to bolster financial discipline, transparency, and protection for homebuyers. 🔹 Three Accounts Required: 1. Homebuyers' Account: For receiving payments from homebuyers. 2. Escrow Account: To hold 70% of the funds allocated for the project. 3. General Account: For the remaining 30% of the funds received. This move aligns with the December 2023 mandate by Uttar Pradesh RERA (UPRERA), and aims to enhance the credibility of the real estate sector. The designated collection and separate accounts will receive legal protection from attachment by government agencies, boosting the confidence of flat purchasers. Previously, developers maintained a single designated account with 70% of the project cost in an escrow account. The new rule addresses issues where developers asked homebuyers to deposit money into different accounts, ensuring financial discipline and accountability. Ajoy Mehta, Chairman of MahaRERA, emphasized that this decision is about building trust among homebuyers, legally empowering them, and securing their investments. 🌟 Exciting News from RERA Vision! 🌟 We are thrilled to share that the Centre has advised state governments to adopt the "Gujarat model" for recovering dues from builders who defy Real Estate Regulatory Authorities (RERA) orders. This model's effectiveness includes appointing officers to execute recovery orders, issuing detailed execution proceedings with provisions for arrest and detention, and initiating suo moto property attachment proceedings. 🏛️ In a recent meeting chaired by the Union Housing Secretary, it was recommended that states designate additional district magistrates or collectors as "revenue recovery officers" for enforcement. This is especially crucial in districts with high pending cases, aiming to bolster compliance with RERA orders. The Federation of Public Cooperative and Institutional Housing Societies (FPCE) welcomed this move, noting the widespread challenges homebuyers face due to non-enforcement of RERA orders.
