The Hon'ble District Judge-Commercial Court, Rohini, has ruled in favor of Lumax Industries Limited in the case of 𝐋𝐮𝐦𝐚𝐱 𝐈𝐧𝐝𝐮𝐬𝐭𝐫𝐢𝐞𝐬 𝐋𝐢𝐦𝐢𝐭𝐞𝐝 & 𝐎𝐫𝐬. 𝐯𝐬. 𝐇𝐢𝐧𝐝𝐮𝐬𝐭𝐚𝐧 𝐀𝐮𝐭𝐨 𝐈𝐧𝐝𝐮𝐬𝐭𝐫𝐢𝐞𝐬 [𝐂𝐒 (𝐂𝐎𝐌𝐌) 311/21]. The court awarded ₹2 Lakhs in damages and issued a decree of permanent injunction restraining the Defendant from using trademarks - YUCOMAX and/or trade dress deceptively similar to the well-known “MAX” family of trademarks, including “LUMAX.” The Firm, through Ms. Tanya Arora represented the Plaintiff. In a Trademark Infringement suit, the 𝐇𝐨𝐧’𝐛𝐥𝐞 𝐃𝐞𝐥𝐡𝐢 𝐇𝐢𝐠𝐡 𝐂𝐨𝐮𝐫𝐭 has granted an interim injunction in favour of 𝒁𝒚𝒅𝒖𝒔 𝑯𝒆𝒂𝒍𝒕𝒉𝒄𝒂𝒓𝒆 𝑳𝒕𝒅. against 𝑨𝒍𝒅𝒆𝒓 𝑩𝒊𝒐𝒄𝒉𝒆𝒎 𝑷𝒗𝒕. 𝑳𝒕𝒅. [CS(COMM) 516/2023, I.A. 14145/2023 & I.A. 3116/2024] The judgment re-emphasises the settled law that confusion between medical products is life threatening and not merely inconvenient. The Hon’ble Court has found a prima facie case in favour of the Plaintiffs and held that the rival marks are bound to cause confusion.
