Unlocking Opportunities in India: SMA Legal at the Indo-Icelandic Business Forum 2025 M.r. Shantanu Mohan Puri, Managing Partner at SMA Legal, was invited by the Indo-Icelandic Business Association to speak in the Business Forum on "Unlocking Opportunities in India", held on February 11, 2025, at ITC Maurya, New Delhi. Organized by the Embassy of Iceland in collaboration with Business Iceland, the forum brought together key stakeholders to discuss bilateral trade and investment between India and Iceland. Mr. Puri’s participation and active contribution to the panel discussion on "Key Considerations for Doing Business in India," alongside Mr. Kumar Sitaraman, Hon. CG of Iceland & Chairman, Automatrix Hotels & Resorts, and other industry leaders was widely appreciated. The discussion focused on regulatory frameworks, market potential, and strategies for international businesses in India. Mr. Puri shared insights on legal issues and the legal framework for doing business in India. The event culminated with a reception for the participants, visiting dignitaries and companies from Iceland hosted by the Ambassador of Iceland to India, Mr. Benedikt Höskuldsson.

Strengthening refugee protection through comprehensive policies and humanitarian initiatives is crucial for addressing this growing crisis.

Recognizing this, India's legal framework offers protections to uphold their dignity, financial stability, and healthcare needs. Key Legal Protections Constitutional Safeguards: · Article 21: Guarantees the right to life with dignity, extending to healthcare and a healthy environment. · Article 41: Directs the State to secure public assistance for old age and disablement. · Article 46: Protects the vulnerable, including senior citizens, from exploitation. Statutory Protections: The Maintenance and Welfare of Parents and Senior Citizens Act, 2007: · Mandates maintenance by children/legal heirs (Section 4). · Empowers seniors to reclaim property if neglected (Section 23). · Directs states to establish old-age homes (Section 19). Criminal Procedure Code, 1973 (Section 125): Allows maintenance claims before magistrates. The Pensions Act, 1871: Ensures government pensions for retirees. Hindu Adoption and Maintenance Act, 1956: Legally binds children to support their elderly parents. Tax Benefits & Welfare Programs: · Higher tax exemptions for senior citizens under the Income Tax Act, 1961. · Healthcare and social security initiatives like the National Programme for Healthcare of the Elderly (NPHCE) and Indira Gandhi National Old Age Pension Scheme (IGNOAPS). Challenges & The Way Forward Despite legal provisions, issues like elder abuse, financial insecurity, and social isolation persist. Drawing inspiration from nations like Japan and Germany, India can strengthen its framework by introducing: · Robust elder abuse prevention laws. · Decision-making support for incapacitated seniors. · Social inclusion programs promoting active aging. India's commitment to safeguarding its senior citizens must evolve, bridging the gap between existing laws and their effective implementation to ensure a life of dignity for its elderly population.
