Key amendments include: 1) The Foreign Exchange Management (Deposit) (Fifth Amendment) Regulations, 2025: Enabling fund transfers between repatriable Rupee accounts for legitimate transactions. Non-residents can utilize SNRR accounts for business dealings, while exporters can maintain foreign currency accounts abroad for export earnings, advance payments, and imports. 2) The Foreign Exchange Management (Foreign Currency Accounts by a person resident in India) (Fifth Amendment) Regulations, 2025: Allowing exporters to establish and operate foreign currency accounts overseas for repatriating export earnings and advance payments. 3) The Foreign Exchange Management (Mode of Payment and Reporting of Non-Debt Instruments) (Third Amendment) Regulations, 2025: Outlining acceptable payment methods, issuance timelines, and repatriation guidelines for investments by non-residents, encompassing equity instruments, FPIs, LLPs, venture capital funds, investment entities, and Indian Depository Receipts. Start-ups can issue convertible notes to non-residents with funds transferable abroad or credited to repatriable accounts.
