We are pleased to share an exciting development that will significantly affect cross-border business activities between Kenya and Singapore. On September 23rd, 2024, Kenya and Singapore signed a new Agreement for the Elimination of Double Taxation with respect to Taxes on Income and the Prevention of Tax Evasion and Avoidance. This agreement, which replaces the previous one from June 12th, 2018, was approved by the Kenyan Cabinet on February 11th, 2025, allowing for formal ratification to begin. This landmark agreement aims to clarify the taxing rights of both countries, address double taxation, and foster cross-border investment and trade. We believe this development will lower barriers to cross-border investment and boost economic flows between the two countries once the DTA’s are ratified by both countries’ legislatures and are in force. Starting February 2025, the Pensionable Income Limit under the NSSF Act 2013 will increase from KES 36,000 to KES 72,000. This means the maximum NSSF deduction will be 6% of KES 72,000, amounting to KES 4,320 from the employee, with an equal contribution from the employer.
