We successfully acted for Stanbic Bank Kenya in an appeal against the Tax Appeal’s Tribunal (TAT) decision which had held that services provided to persons registered outside Kenya were local services that are subject to Excise Duty. The High Court agreed with us that the determination of an export of service is based on whether the service is used or consumed outside Kenya pursuant to Section 7(1) and 7(4) of the Excise Duty Act. Consequently, the High Court held that services provided to international organisations and other persons who are based outside Kenya, are used or consumed outside Kenya and hence are exported services. Our team was led by Nazima Malik.
