🚨 Justice Denied in Two Lines! 🚨 On Friday, 7th February 2025, we appeared in court for the judgment in Petition E008 of 2023—a case demanding accountability from the Cabinet Secretary for Health and KEMSA for their failure to ensure uninterrupted, quality healthcare for Persons Living with HIV. What did we get? A two-line ruling dismissing the petition, without any reasons. Just like that, the hopes of the petitioners were crushed. 🚨 Major Judgment Alert 🚨 Today, 7th February 2025, the High Court will deliver its judgment in the ARV case, a landmark moment for the right to health and access to life-saving treatment in Kenya. For years, communities affected by HIV have faced disruptions in access to quality antiretroviral (ARV) medication due to systemic failures and policy gaps. This case is not only about medicine, but also about dignity, justice, and accountability for thousands of people who rely on consistent treatment to survive and thrive. At KELIN, we have stood alongside communities, advocating for a health system that prioritizes human rights over bureaucracy. Today’s ruling has the potential to set a precedent for government accountability in ensuring uninterrupted access to essential medicines. Advancing the Right to Health: A Shared Responsibility for a Healthier Future As we commemorate International Human Rights Day 2024 under the theme "Our Rights, Our Future, Right Now," we are reminded of the profound importance of protecting, promoting, and respecting human rights, particularly the right to health. During today’s Breakfast Roundtable, convened by KELIN as part of the Universal Periodic Review (UPR) Right to Health Thematic Group, we engaged with over 300 organizations, reflecting on the strides made and the challenges that lie ahead. From submitting 30 well-researched reports to Geneva to conducting 50 impactful training sessions, we have worked collectively to amplify the voices of CSOs and push for transformative changes in Kenya’s healthcare system. Key takeaways: 1. Finance: Increasing health budget allocations to meet international standards, including the Abuja Declaration target of 15%. 2. Infrastructure: Strengthening data systems and healthcare facilities to ensure universal access. 3. Legal and Policy Environment: Improving existing policies and ensuring their implementation to uphold the right to health for all. Healthcare, as affirmed by Article 43 of the Constitution of Kenya and various international treaties, is a fundamental right intertwined with dignity, equality, and freedom. Yet, our healthcare system faces persistent challenges, including underfunding, stigmatization of marginalized groups, and gaps in mental health services and digital health frameworks. As Nelson Mandela profoundly stated, "Health cannot be a question of income; it is a fundamental human right." These words resonate deeply as we renew our commitment to advancing the right to health, ensuring no one is left behind. We also take a moment to appreciate the power of partnerships, governments, foreign embassies, UN agencies, CSOs, and communities working together to drive change. A united front is essential to overcoming systemic barriers and achieving universal health coverage (UHC) that is inclusive, affordable, and accessible to all. The UPR process is a unique opportunity to hold our government accountable and push for progressive reforms. As Kenya approaches its fourth UPR session in 2025, let us use this moment to reflect on our progress, advocate for evidence-based policies, and solidify partnerships that will sustain and strengthen our healthcare systems. This journey is not just about policies and frameworks, it is about reclaiming rights, rebuilding lives, and creating a healthier future for all Kenyans. As we commemorate Human Rights Day, let us remember the power of the Kenya Constitution, which guarantees every Kenyan the right to health under Article 43. Unfortunately, healthcare remains out of reach for many due to high costs, limited access, and quality disparities. KELIN, we believe in a future where every Kenyan no matter their background or economic status, has access to affordable, accessible, and quality healthcare. This is not just a moral duty but a constitutional obligation. Article 159 calls for the promotion and protection of rights, including economic and social rights such as healthcare. It’s time for action.
