    #GoodToKnow 📢 CJEU Clarifies “Legitimate Interest” Under GDPR for Commercial Data Processing The Court of Justice of the European Union (CJEU) has clarified how organisations can use the “legitimate interest” basis under GDPR to process personal data for commercial purposes—like marketing—without explicit consent. This guidance stems from a case involving the Royal Dutch Lawn Tennis Association (KNLTB), which faced a €525,000 fine for sharing member data with sponsors for marketing. The CJEU’s decision reinforces the three critical criteria for relying on legitimate interest: 1️⃣ Pursuit of a lawful, legitimate interest 2️⃣ Necessity of data processing to achieve that interest 3️⃣ Proper balancing of interests between organisations and individuals. This guidance supports businesses in protecting G7 technologies from unauthorised use, managing reputational and liability risks, and reinforcing current regulatory measures. Introduced alongside the G7’s Enforcement Coordination Mechanism (ECM), which includes a dedicated Sub-Working Group for Export Control Enforcement, the guidance provides industries with a list of high-risk items, updated indicators of sanctions evasion, best practices for risk management, and resources to strengthen due diligence processes.
