Big news for the EV charging world! The Court of Justice of the European Union's decision in Digital Charging Solutions (Case C-60/23) has arrived, bringing good news for EV charging app/card operators (eMPs). What’s the verdict? eMPs are now normally recognized as part of the electricity supply chain as commissionaires, not VAT-exempt credit service providers. This means they should usually be able to fully deduct input VAT. This is a shift from previous rulings on fuel card issuers, who were considered to provide exempt financial services, resulting in limited VAT deductibility. But that’s not all! Additional services offered by eMPs may, depending on the circumstances, have separate VAT treatment. Special place-of-supply rules for electricity also apply. See otsus on märgiline mitmes aspektis:: ⚖️ Ülikooli argumendid olid asjakohased: Riigikohus leidis, et Tartu Ülikooli põhjendused finantskorrektsiooni aluste puudumise kohta olid menetluse jooksul asjakohased. ⚖️ Hankemenetlus ei olnud piirav: Kohus kinnitas, et etteheited välisriigi pakkujatele hankest osavõtu piiramise kohta ei olnud põhjendatud. ⚖️ Proportsionaalsus: Kohus rõhutas, et toetuse tagastusnõue peab olema proportsionaalne, võttes arvesse kõiki olulisi asjaolusid, sealhulgas hüpoteetilist kahju ELi eelarvele ja konkurentsi hankes. See märgiline otsus kinnitab õiguste kaitset ELi struktuurivahendite kasutamisel ning loob pretsedendi, mis julgustab toetuste taotlemist ja vähendab formaalsete eksimuste alusel ebaproportsionaalseid karistusi. On November 21, a large audience gathered in the Small Auditorium of the Latvijas Universitate to attend the award ceremony for the 19th Žurnāls "Jurista Vārds" Student Research Competition. This year, Jurista Vārds received 42 research papers, including 30 bachelor's and master's theses, competing across various sections of law. The Main Prize of the Jurista Vārds Student Research Competition, named after Professor Kalvis Torgāns, was awarded to Kristīne Nagle. Her Master's thesis also secured first place in the State Law Section. WALLESS partner Sandis Bērtaitis presented the award to Kristīne Nagle in the State Law Section for her thesis, "Intertemporal Applicability of Substantive Law Norms in Administrative Proceedings."
