The European Commission has rejected the draft Regulatory Technical Standards (RTS) on ICT subcontracting proposed by the European Supervisory Authorities (ESAs). A six-week period has been granted to the ESAs to make the necessary amendments. This rejection creates legal uncertainty across the EU and gives rise to challenges for those seeking to comply with their DORA obligations, especially those financial entities who have already implemented the draft RTS in their DORA agreements or addenda.
