In the Amazon, research has affirmed that Indigenous Peoples' territories conserve biodiversity as effectively as protected areas. However, what is less known is that many, if not most, of these protected areas are actually Indigenous Peoples' territories, according to international law. Here is what jurisprudence under international laws says: 📜 International Convention on the Elimination of All Forms of Racial Discrimination (ICERD): Its treaty body has affirmed that "Indigenous peoples’ rights to traditional territories exist independently of domestic legislation, and the fact that the national legislation does not award them formal title is therefore irrelevant, according to international human rights law." See https://lnkd.in/eeBkT8iy 📜International Covenant on Civil and Political Rights (ICCPR): Its treaty body has affirmed that the Convention "enshrines the inalienable right of Indigenous Peoples to enjoy the territories and natural resources that they have traditionally used for their subsistence and cultural identity." See https://lnkd.in/edW3rZKd 📜 International Covenant on Economic, Social and Cultural Rights (ICESCR): Its treaty body has affirmed that "States must take measures to recognize and protect the rights of Indigenous Peoples to own, develop, control and use their communal lands, territories and resources, and, where they have been otherwise inhabited or used without their free and informed consent, take steps to return these lands and territories." See https://lnkd.in/eida_3zm 📜The Inter-American Court of Human Rights finds that the following criteria are essential for protected areas to be compatible with Indigenous rights: a) effective participation in the administration of and protection of their territories b) access and use of their traditional territories and c) the possibility of receiving benefits from conservation. See https://lnkd.in/eW7HYbfe In other words, the contribution of Indigenous Peoples' territories to conservation is higher than often perceived, since many of the protected areas are also Indigenous Peoples' territories, even if Indigenous Peoples lack formal recognition through titling and demarcation. Moreover, the obligation to consult Indigenous Peoples and obtain their free, prior and informed consent, and ensuring fair and equitable sharing of benefits also applies for the territories where Indigenous Peoples lack official recognition and land titling, including those that have been categorized as protected areas (often without Indigenous Peoples' consent). Those are crucial imperatives for the implementation of Target 3 of the Kunming Montreal Global Biodiversity Framework, which stipulates that 30% of the world’s land and marine areas should be conserved by 2030, recognizing and respecting the rights of Indigenous Peoples to their traditional territories.
