In a significant legal development, a Brazilian court has issued a worldwide injunction against Adele’s Million Years Ago, ordering its removal from streaming services and other platforms. This comes as part of an ongoing plagiarism dispute brought by Brazilian composer Toninho Geraes, who claims the song mirrors his 1995 samba classic Mulheres. Judge Victor Torres’ preliminary injunction marks a major moment for intellectual property rights, particularly for Brazilian music, which has often influenced international hits without due recognition. The decision mandates Sony and Universal to cease all use, reproduction, and commercialization of the song globally or face substantial fines. Why this matters? This case highlights the importance of protecting local music traditions and ensuring creators receive proper credit and compensation. The ruling could set a precedent for international producers and artists to approach cultural influences with greater caution and respect. Brazil’s role as a signatory to the Berne Convention underscores the global nature of copyright enforcement. As music transcends borders in the digital age, rulings like this challenge the industry to balance inspiration with intellectual property protection. This decision is a milestone for composers and artists advocating for recognition and fair compensation. Whether upheld or overturned on appeal, its implications will resonate across the music industry. #IntellectualProperty #MusicRights #CopyrightLaw #Adele #MusicIndustry

The recent Inaugural Malaysian Bar ESG Conference was insightful, delving into topics such as ESG Laws & Regulations, Litigation Landscapes and International Perspectives, Green Financing and Tax Incentives, and Carbon Credit Trading. #ASL was pleased to have been the Conference Session sponsor, with our Banking and Finance partner Rishen Nadarajan speaking together with Andreanna Ten Wei Ta Saw and Rosman Mamak Rapi from Malaysian Green Technology & Climate Change Corporation and moderated by Darren Lai on green financing and tax incentives available from the government as well as financial institutions. A big thank you to Abhilaash Subramaniam the Chairperson of the Malaysian Bar Council Joint Committee on ESG who is also our Strategic Alliance on ESG, for organising this significant conference. Whilst Malaysia does not currently have a singular framework, we have in place laws and regulations which are not overlapping and continuously evolving to support the development of #ESG. As businesses move beyond mere compliance, we can look forward to balancing profitability with sustainability and social responsibility, thereby creating a positive impact on people and planet.

#ASL is proud to have been the Silver Partner at the recent Sports Law Conference 2024: "Game Changers: Legal Evolution in Sports" organised by the Sports Law Association of Malaysia (SLAM) which served as a valuable platform to discuss the evolving challenges and opportunities in sports law. This year’s focus on diversity, equality, and sports governance provided great insights into creating a more inclusive and transparent sporting landscape. It was a pleasure for our Intellectual Property, Sports and Gaming partner Sri Sarguna Raj who is also the President of SLAM, to speak at the 1st session of the conference alongside Ridwuan Mahamud (General Manager - Marketing, Selangor FC), which was well moderated by Danesh Thiagarajah (Treasurer of SLAM). This session on Technological Innovations in Sports delved into the emerging legal landscape as new technologies continue to reshape the sports industry. Jacques Blondin Attorney-at-Law and Former Head of FIFA TMS and FIFA Regulatory Enforcement Department with 10-years experience at FIFA, also provided interesting insights into the football transfer system (contracts, FIFA TMS, FIFA Clearing House) and corruption in football transfers. From the legal implications of data analytics and wearables to innovations in fan engagement, it was an insightful discussion on how the legal field must keep pace with these advancements. #sportslaw #sportstechnology
