Azmi & Associates Secures Malaysian Bar Council's License Renewal for Foreign Qualified Lawyer, Pierre Brochet Azmi & Associates is pleased to announce that our Foreign Qualified Lawyer, Pierre Brochet has successfully renewed his license to practice English law in Malaysia for another term, focusing on Corporate Finance, Capital Markets, Banking & Finance and Derivatives matters effective December 2024. This license, granted by the Bar Council Malaysia under the Legal Profession Act 1976, will remain valid for one year, further solidifying his continued contribution to the Firm. Pierre, who joined Azmi & Associates in 2018, was the first lawyer to register as a Foreign Qualified Lawyer in Malaysia. With more than 25 years of experience in high-profile private practice roles in London, New York, and emerging markets, Pierre brings a wealth of knowledge and an international perspective to the firm. He is qualified to practice as a Solicitor of the Senior Courts of England and Wales and is also admitted to practice in France. Over the course of his career, Pierre has provided counsel to multinational corporations, investment banks, and institutional investors on complex financial transactions across Europe, the USA, and Southeast Asia. His expertise spans an array of sectors, from securities issuance and investment-grade credit facilities to structured financing, asset-based transactions, and debt restructurings. Before joining Azmi & Associates, Pierre was a partner in international law firms in London and Paris. He has also held significant associate roles at prestigious law firms in New York and London where he advised on major transactions in the finance and corporate sectors. Pierre holds an academic foundation that is both broad and deep. He earned his Maîtrise in Law from the University of Paris, followed by an LL.M in International Business Law from King’s College London. He further enhanced his legal education with studies at the University of Edinburgh. When a company is wound up, the liquidator is tasked with managing its assets, settling debts, and balancing creditor claims. A critical step for creditors to recover debts from the company is the submission of a Proof of Debt (“POD”). This document quantifies the amount owed by the company and must be supported by evidence such as invoices, contracts, court orders, or bank statements. The procedure for submitting a POD is outlined in the Companies (Winding-Up) Rules 1972 (“WUPR”), specifically under Rules 78 to 100. The liquidator examines these claims to decide whether to admit or reject them. If a POD is rejected, creditors have the right to appeal the liquidator's decision to the court under Rule 93 of the WUPR.
