  • On 5th-8th July 2024, the Firm embarked on an unforgettable trip to the stunning landscapes of Kota Kinabalu and Kundasang. From enjoying the sun-kissed tropical beaches and islands, indulging in unbelievably fresh and scrumptious seafood, to taking in the majestic views of Mount Kinabalu, it was truly an adventure to remember!   • On 15.3.2024, a Mock Trial was conducted with the participation of 3 Firms: Messrs. Shah & Wong , Messrs Choo Dee Wei (Choo Dee Wei ) and Messrs Anton & Chen (Alex Netto & Chen Yu Szen held in our office. These participants include paralegals (including our Yew Jie Wei), interns and pupils alike. This recent face-off with fellow firms was not just about competition, but also a profound journey of practical learning on advocacy skills and Court decorum. Kudos to Chen Yu Szen for organising a realistic simulation of a Criminal Trial from the facts, witness-preparations and documents. And of course a huge shoutout to Sashi Devan for presiding as the 'Tuan Majistret' whom have graciously shared his vast knowledge and experience on Criminal Proceedings. Here's to molding more future lawyers! #mocktrial

  • Generally, appeals are a closed book, confined only to the evidence presented in the earlier trial court. No new or rather, “fresh” evidence (“Fresh Evidence”) is allowed to be introduced in an appeal. But what if you discover a Fresh Evidence that would have been relevant in the earlier trial court? So relevant that it may have helped tip the balance of the trial in your favour? Rest assured, like all general principles, there are exceptions. An Appellate Court may exercise its discretion in allowing Fresh Evidence to be admitted in an appeal should certain conditions be satisfied. What are these conditions you may ask? Such an applicant needs to strictly demonstrate that such Fresh Evidence is:- (a) relevant and/or has an important or determining influence in the decision of the earlier trial court, as well as in the appeal at hand; (b) unobtainable with reasonable diligence for use at the time of the trial in the earlier trial court; and (c) credible in nature. Our Azzuan Shah along with Choo Dee Wei (of Messrs Choo Dee Wei) did just that, where they have succeeded in allowing Fresh Evidence to be admitted in an ongoing appeal in the Penang High Court (which was kind enough to have it heard in a virtual courtroom via Zoom). Now that the Fresh Evidence has been admitted into the arena, it is time to gear up and prepare for the main event: the Appeal.
