Our Dispute Resolution Practice Group held an insightful session on 22nd November 2024, as part of our DR Evening Talk Series. This time, the session titled "𝐈𝐧𝐭𝐫𝐨𝐝𝐮𝐜𝐭𝐢𝐨𝐧 𝐭𝐨 𝐁𝐮𝐢𝐥𝐝𝐢𝐧𝐠 𝐂𝐨𝐧𝐭𝐫𝐚𝐜𝐭𝐬" was led by our Partner, Alexius Lee. Alexius Lee, whose practice focuses on building and construction law, with experience in litigation, arbitration (domestic, international, institutional, and ad-hoc), adjudication (both contractual and statutory), and mediation. In this session, Alexius Lee provided an overview of key aspects of building contracts, including the roles of contracting parties, distinctions between conventional and design-and-build contracts, and fundamental provisions such as pricing, completion timelines, and variations. The session provided valuable insights for our young lawyers and pupils, highlighting good practices for navigating the complexities of building contracts. 𝐉𝐮𝐝𝐢𝐜𝐢𝐚𝐥 𝐑𝐞𝐯𝐢𝐞𝐰 𝐁𝐨𝐨𝐤 𝐋𝐚𝐮𝐧𝐜𝐡 On 7th October 2024, the Chief Justice of Malaysia, YAA Tun Tengku Maimun Binti Tuan Mat, officiated the launch of the book, "Judicial Review in Malaysia – Case Commentaries on Key Topics" at the Asian International Arbitration Centre . This practitioner’s book features contributions from our Partner, G. Rajasingam, and Associates, Justin Tong and Ally Ong Tze Xian. The momentous event was also attended by Federal Court Judge, Justice Datuk Vazeer Alam, Sabah State Attorney-General, Datuk Brenndon Soh, and other notable guests. Whilst Judicial Review is a developing creature, General Editors, Justice Datuk Noorin Badaruddin, Judge of the Court of Appeal and Mr. S Saravana Kumar, along with our G. Rajasingam, Justin Tong and Ally Ong Tze Xian, and other learned contributors, have striven to put together the key and developing legal principles pertaining to Judicial Review Proceedings into one book for ease of reference. On 20th November 2024, YSIAC Malaysia held an Arbitration Quiz Night and a networking reception hosted by Shearn Delamore & Co. It truly was a merry and most sporting evening as participants gathered for an exciting evening of drinks, laughter and competition. Our Dispute Resolution Partner, Shanti Mogan, began the event with her opening remarks, highlighting Singapore International Arbitration Centre (SIAC)'s international presence, its role as a global venue for arbitrations, and the sense of community among its members, many of whom were also present at the Quiz Night and reception. YSIAC Council members, Lilien Wong (our Dispute Resolution Partner) and Jocelyn Lim, organised the event and hosted a quiz. The quiz covered various topics, including the Arbitration Act in Malaysia, SIAC rules and procedures, as well as our firm’s history and origins. We welcomed attendees from Malaysia, Indonesia, Singapore, Myanmar and India, all of whom had a fun time engaging in light banter and friendly competition before finally concluding the night over drinks and refreshments. #ShearnDelamore #YSIAC

On 21st November 2024, Shearn Delamore & Co. and Thomson Reuters co-organised a half-day seminar entitled “ESG in the Boardroom”. We had the privilege of hosting The Hon. Justice Tan Sri Datuk Nallini Pathmanathan, Judge of the Federal Court, who delivered an illuminating opening address on “ESG And The Law – Redefining Corporate Responsibility”. This was followed by a panel session entitled “Navigating The ESG Landscape – Challenges And Solutions” which dealt with the challenges faced by companies, directors and senior management with regard to ESG framework introduced by the regulatory authorities and discussed practical solutions to address these challenges. The panellists for this session were Amarjit Chhina, Geehanthie Rasaputra, Nooryusazli Y. and Saravanan Desigamanie. The session was moderated by our Corporate Partner, Zhen Pik L. The second panel session entitled “Global ESG Litigation Trends – Where Are We Headed?”, focused on the continuing proliferation of ESG litigation globally, and the implications of said litigation in the Malaysian context. The panellists for this session were Benjamin Gaw (吴永灿), Dalvin Kaur, Dr. Sheila Ramalingam and the Head of our Environmental Practice, Dhinesh Bhaskaran. Driving the discussion was Dispute Resolution Partner, Lilien Wong, who acted as the moderator. The seminar was well-attended by more than 140 attendees from diverse backgrounds, ranging from sustainability professionals and corporate counsel to C-Suite officers and Directors.
