    Supercharging Sustainability | CSRD | ESG Strategy & Advisory

    IG 2: Value Chain Implementation Guidance - great tool for practitioners! Both focus on implementing the Corporate Sustainability Reporting Directive (CSRD) in alignment with the European Sustainability Reporting Standards (ESRS). Key insights from the documents includes, IG 1: 'Materiality Assessment Implementation Guidance' emphasizes the double materiality perspective. Reporting entities must address both impact materiality (effects on the environment and people) and financial materiality (risks or opportunities affecting the entity's financial position) and hence include value chain information. Material impacts, risks, and opportunities (IROs) in the value chain—both upstream (suppliers) and downstream (customers, end-users)—must be included when relevant. This involves identifying material IROs and mapping them against ESRS disclosure requirements or using entity-specific disclosures if ESRS does not cover certain IROs adequately. Engaging stakeholders helps identify and substantiate the significance of sustainability matters. Hence, applying thresholds and judgements which refers to a process that involves setting thresholds for what constitutes material IROs based on severity and likelihood, requiring substantial judgement. IG 2: 'Value Chain Implementation Guidance' elaborates on the importance of value chain coverage in sustainability reporting including the importance of scoping as the scope must include the reporting entity’s operations, suppliers, customers, and other relationships influencing its business model. When it comes to upstream and downstream reporting: Material IROs linked to suppliers, customers, and other entities in the value chain must be included in reporting if they are significant. For the application of numbers, estimates and proxies, entities may rely on estimates and proxies for value chain data when primary information is not available. Further, as the significance of value chain transparency may be the biggest challenge due to impacts and dependencies that occur outside the entity's operations. The value chain is critical as it requires a holistic assessment of IROs whereby a narrow focus on an entity's operations risks missing significant upstream or downstream impacts, dependencies, and related financial risks. This may ultimately misinform investors on risks/opportunities. Stakeholders and investors gain a more accurate picture of the entity’s sustainability performance and associated risks. By integrating value chain analysis (IG2) into materiality assessments, entities can ensure that their sustainability disclosures are robust, relevant, hollisticly informed, and aligned with regulatory and stakeholder expectations .

    Belgium has officially transposed the #CSRD into national law! Here’s the breakdown 👇 While the EU deadline was 6 July 2024, Belgium is the 14th member state to transpose the directive, leaving 13 to go. Companies must now go beyond financial data to collect and report on their #ESG performance, aligning with the 12 #ESRS standards and hundreds of data points. The law was adopted with urgency but it now provides a legal foundation to audit reports starting in early 2025. Belgium made only a few amendments: 1️⃣ Protecting SMEs SMEs are shielded from excessive demands regarding ESG information. Unlike larger corporations, they cannot be required to provide more data than EU norms mandate, preventing undue pressure from larger business partners. 2️⃣ Confidentiality Companies can exceptionally withhold information if its disclosure could significantly harm their commercial position. 3️⃣ Sanctions Penalties range from €50 to €10,000 for breaches, with potential imprisonment for fraud. These sanctions are lighter compared to Italy’s fines of €150k for directors or €2.5m for companies. On the other hand, some countries (e.g., Romania, Slovakia) have opted for no penalties. This marks a significant milestone in advancing the green transition within the business world in Belgium. Stay tuned for more ESG reporting updates!

    𝐍𝐨𝐫𝐝𝐢𝐜 𝐏𝐮𝐛𝐥𝐢𝐜 𝐏𝐫𝐨𝐜𝐮𝐫𝐞𝐦𝐞𝐧𝐭 𝐅𝐨𝐫𝐮𝐦 𝟐𝟎𝟐𝟒 (NPP '24) in Copenhagen was a really amazing event. Representatives of the European Commission, the European Court of Auditors, #professors from the Netherlands (University of Twente and Utrecht University School of Economics), Norway (University of Oslo), Germany (University of Bayreuth), Great Britain (University of Nottingham), Denmark (University of Copenhagen), Finland (University of Lapland), as well as of leading #international #law firms gathered to discuss the challenges faced by practitioners in #publicprocurement, as well as new trends in this area. The topic of my speech is “Exploring the untapped potential of public-private partnerships for a greener world” was not exactly about #publicprocurement, although, of course, it also touched on the issues of applying the relevant EU Directive. From experience, I know that #PPP is not something that interests practitioners involved in traditional public procurement. For them, conversations about #PPP are primarily educational and informational in nature. At the same time, the forum's discussions on #AI procurements within the framework of #EUregulation added to the attractiveness of the #PPP and aroused the interest of many forum’s participants. #PPP is an #innovative mechanism and first of all, this concerns institutional #innovations. This feature of #PPP allows us to solve a number of problems that arise when purchasing #innovations, in particular #AI, which arise when trying to do this within the framework of traditional #publicprocurement. After all, in this case, you are not buying only a product that is difficult to evaluate (and this is not only about the cost, but also about the functionality, capabilities, reliability of results), but mostly services that are provided using #AI. And here everything becomes clearer, easier both from the point of view of setting the task (performance indicators) and from the point of view of verification of results. There is something to think about and work on! Thank you for the great presentations, Christoph Krönke (Buying artificial intelligence? EU regulation got you covered) as well as Marlene Winther Plas, Linda Heimisdottir and Milena Anguelova Krogsgaard (Future forecast: exploring AI's impact on public procurement!). Your talks are “food” for thought and new ideas for research. This is exactly what I like to “bring home” from conferences. And, of course, thanks to the organizers - Nohrcon, (Jesper, Trine, Sissel, Sara & Peter) for the wonderfully chosen theme, brilliant speakers and excellent organization of the event! It was warm and soulful!
