The recent High Court decision in Pentagon Food Group Ltd v B Cadman Ltd [2024] EWHC 2513 (Comm) provided a significant opportunity to consider the recognition of a distinct 'mediation privilege.' The judgment reaffirmed the Oceanbulk exception and emphasised the importance of confidentiality in mediation agreements. As ADR continues to evolve, the question of a standalone mediation privilege remains unresolved but increasingly relevant for future legal and legislative considerations. With the conference today and yesterday that I organized with prof. Aukje van Hoek and prof. Ianika Tzankova we aimed to bring practitioners and academics together in having quality discussions around academic papers, in the rapidly evolving field of class actions in environmental, social and governance (ESG) matters. I think we succeeded! In any case, we had interesting discussions on a wide range of topics, from funding and representation to jurisdiction and applicable law, and from corporate sustainability and data protection to reparation for war damages in Ukraine and the downsides of carbon markets for local indigenous communities. A special issue with many of the papers is forthcoming in the Mass Claims Journal. Today, Carlota Ucín - PhD presented her research at the ICAC Workshop 2024: 'Collective actions on Environmental, Social and Governance topics'. Her paper explores the challenges of accessing justice in public interest litigation, particularly in addressing complex issues like climate change. Drawing on comparative experiences, Carlota categorizes public interest litigation into three types: structural reform cases tackling systemic human rights violations, collective claims representing specific groups, and ‘individual test cases’ with broader societal impacts. These frameworks provide practical guidance for litigants and judges, offering strategies to channel environmental claims effectively. In the same event yesterday, Eduardo Silva de Freitas served as an expert discussant for a presentation on the potential role of third-party litigation funding in enhancing access to justice in EU climate litigation. #AccessToJustice #LitigationFunding #DisputeResolution

Dispute resolution clauses are not top of mind when companies conclude an agreement. Usually, the lawyer of the party drafting the agreement adds the law firm’s standard choice-of-court clause to the agreement, and this rarely prompts discussions between the parties. However, the choice for a certain dispute resolution forum is not without consequences and merits particular attention, especially where the agreement is international in nature, e.g. where one of the parties is located in another country.
