EU Court Defines Legal Service Boundaries for Sanctioned Government under Regulation 2022/1904   The General Court of the European Union has clarified the EU's sanctions regime under Regulation 2022/1904, which prohibits the provision of legal services to the Russian government and entities but also sets out important exceptions. Several bar associations brought cases arguing that the sanctions violate fundamental rights such as access to legal advice and professional secrecy.   The judgments in cases T-797/22, T-798/22 and T-828/22 confirm that the sanctions do not apply to legal services provided in connection with judicial, administrative or arbitral proceedings. However, the prohibition continues to apply to legal services unrelated to such proceedings. Legal services unrelated to judicial or arbitral proceedings remain prohibited when provided to the Russian Government or entities.   The EU General Court's decision provides a significant level of reassurance and clarity to legal practitioners, particularly in the area of arbitration. Case: Dutch court enforces ICC award despite allegations of fraud and public policy challenge by Central Bank of Iraq (CBI) In a 2023 ICC arbitration, the Central Bank of Iraq (CBI) was ordered to pay substantial damages to an Emirati group in connection with certain claims relating to a construction project in Baghdad. In an attempt to set aside the award, the CBI filed an application for annulment in Paris, alleging fraud by the Emirati group. Meanwhile, in a separate enforcement case in the Netherlands, the Amsterdam Court of Appeal upheld the award. In a decision published in September 2024, the court rejected CBI's fraud and public policy defences, finding that the bank had been aware of these issues during the arbitration but had failed to raise them with the arbitrator in a timely manner before the end of the proceedings. (ECLI:NL:GHAMS:2024:1974) This decision, although rendered by a national court, highlights the resilience of arbitral awards, even when challenged on serious grounds such as fraud and public policy.
