Hij heeft zijn kennis en ervaring opgedaan in de advocatuur, maar ook als bedrijfsjurist bij een projectontwikkelaar. Did you know that public and private laws can clash when it comes to property in Amsterdam? In a case earlier this year, a leaseholder requested to convert a plot intended for 1 semi-detached single-family home into 3 smaller rental properties. He received a (public law) environmental permit and conversion permit for this, but not civil law permission from the municipality (as leaseholder). The court ruled in favor of the municipality, emphasising that civil leasehold terms can coexist with public laws, especially when specific public aspects (like parking) aren’t considered in permit reviews. This case underscores the complex interplay between civil and public rules, especially in Amsterdam where unique leasehold rules apply. Starting 1 January 2025, Dutch REITs ("fiscale beleggingsinstelling (fbi)") will no longer be permitted to directly invest in Dutch real estate. This legal change, introduced by the previous Dutch government in 2023, effectively ends the use of tax-exempt vehicles (with a 0% corporate income tax) for collective indirect investment in Dutch real estate.
