At yesterday's #IEL Employment Summit in Paris. Stephan Pötters Innangard member and Partner in Seitz participated on a panel together with Jean-Marc Albiol, Anne-Charlotte (Vernay) Cazalet, Donal Hamilton, and Jemina Coleman on the impact of the EU Corporate Sustainability Reporting Directive (#CSRD) on labour rights, workforce management, and employment law. The panel discussed practical challenges companies face in aligning their business with the new rules, and how the recently announced “omnibus package” will lighten the bureaucratic burden. Key takeaways: 🔸 Workforce classification challenges: defining who counts as an “employee”. Companies must ensure freelancers and external workers are correctly categorized to avoid legal issues. 🔸Practical challenges in compliance, data collection and standardization across multiple jurisdictions is complex. 🔸High administrative burden: many businesses struggle to align internal reporting systems with CSRD requirements. 🔸Delayed implementation for smaller companies, we need to give businesses more time to adjust. 🔸Companies see ESG initiatives as crucial for brand reputation and attracting talent. 🔸Works councils and unions will play a bigger role in ESG reporting. Until national legislation transposes the EU Directive, key details—such as pay reporting, and enforcement—will remain unclear. While employers should start preparing, true compliance will depend on specific legal frameworks set by governments. Mathilde highlighted France’s proactive stance on equal pay, particularly through the Gender Equality Index (Index de l’égalité professionnelle). Since 2019, companies with at least 50 employees must measure and report their gender pay gap annually. A score below 75 out of 100 triggers mandatory corrective measures—or fines of up to 1% of total payroll. Beyond financial penalties, the reputational risk of non-compliance is just as significant.
