This resource is the product of a collaborative effort between the Georgetown International Arbitration Society (GIAS), Signature Litigation, and Young OGEMID. The transnational dispute management journal (TDM) and oil gas and energy law journal (OGEL) are innovative and thought provoking journals about international arbitration and energy law. The journals started publishing in 2003 and have since become known for their up-to-date, valuable and engaging contents. The journals bring together academics, judges and in-house counsels and other leading professionals in arbitration: creating a network of people working in the same field, but with different interests. The OGEMID forum is used to engage in discussions between these different groups. OGEMID has managed to become the only discussion platform in the world that provides these valuable insights.

Alecta Tjänstepension Ömsesidig has initiated arbitration proceedings against Heimstaden Investment AB, a wholly owned subsidiary of Heimstaden AB (publ) under the shareholders agreement pertaining to Heimstaden Bostad AB (publ) Alecta argues that the establishment of Heim Global Investor AS by Fredensborg AS / Ivar Tollefsen, and the investments into its fund, competes with the business of Heimstaden Bostad AB (publ) and thus constitutes a breach of the shareholders agreement. Heimstaden Investment AB disagrees, noting that Heimstaden Bostad AB (publ) is not active within the business of fund management and that the investment made by Heim Global Investor AS's fund falls within the exemption to the non-compete undertaking in the shareholders agreement.

This was the first in a series of workshops that will be organised under the MSP Forum. The workshop took place in Brussels during the 2024 edition of Raw Materials Week. Participants discussed three key issues: the challenges facing investors, government policies aimed at fostering the development of the critical raw materials sector, and ways to mobilise investment to increase local value addition. Fostering investment in critical raw materials and creating sustainable local value addition for resource-rich countries is a key facet of the MSP Forum. Participants from financial institutions highlighted the importance of de-risking the investment climate to facilitate more investment, while government representatives outlined how successful policy initiatives can support greater development of the critical raw materials sector. Finally, representatives from civil society provided valuable insights into the inclusion of local communities, and the importance of upholding the highest possible sustainability standards and mitigating environmental and social risks in critical material projects.

Since the last update of June 27, 2024, the following key milestones have been met: - Each of the Company and Mexico has appointed an arbitrator to the three-person arbitration panel (the "Tribunal"); - The third and presiding arbitrator has also been appointed, and the Tribunal has now been duly constituted. The place of the arbitration is Washington, D.C.; - The Tribunal held its first session with the Company and Mexico on November 20, 2024; - As determined by the Tribunal, the Company will submit its Memorial document, which describes in detail the Company's legal arguments and evidence, by March 20, 2025; - The Company has engaged a quantum expert to assess the damages relating to the Claim. This work will form an important part of the Memorial submission; - The Company and its legal representatives at Boies Schiller Flexner continue to prepare the case. Document analysis and interviews with pertinent personnel and experts are progressing as scheduled.

The Czech Republic has won an investment arbitration case brought by Israeli developer Asael Halevi. The tribunal dismissed all claims worth CZK 165 million (USD 7 million) and awarded the Czech Republic its costs. The investor claimed that the Czech Republic had allegedly expropriated land on the outskirts of Prague and that the Czech courts had failed to provide the investor with due process. The investor also claimed that the legislation of the Czech Republic was not stable and predictable. The tribunal rejected all claims, emphasizing, as did the Czech courts, that the land purchase contracts concluded by the investor's company were invalid from the outset. Therefore, the State could not have expropriated the land as the company had never acquired ownership of the land in the first place. The Tribunal also rejected the claim that the Czech courts had failed to ensure a fair trial. Finally, the Tribunal confirmed that the legislation of the Czech Republic was stable and predictable when, following the blocking provisions of the Land Act, the Church Restitution Act was later adopted. It's another excellent result for our arbitration team. My special thanks go to my colleagues Lenka Kubická, Tereza Ševčíková and Elizabeth Belova. We also had excellent cooperation with Alfred Siwy and Ondrej Cech from ZEILER Rechtsanwälte. This is the 32nd victory for the Czech Republic in investment arbitration. Last year, the Czech Republic successfully defended a CZK 3.6 billion (USD 164 million) investment claim in WCV Capital Ventures Cyprus Limited and Channel Crossings Limited v. This paper examines the evolving landscape of monitoring and evaluation mechanisms among investment promotion agencies (IPAs) in OECD member countries, with a particular emphasis on the integration of sustainability metrics. It explores the developments, depth and effectiveness of these monitoring and evaluation systems in measuring sustainable investments across agencies. The analysis primarily draws on data collected from a 2023 survey on monitoring and evaluation of sustainable development conducted with 33 national IPAs in OECD member countries.
