This resource is the product of a collaborative effort between the Georgetown International Arbitration Society (GIAS), Signature Litigation, and Young OGEMID. The transnational dispute management journal (TDM) and oil gas and energy law journal (OGEL) are innovative and thought provoking journals about international arbitration and energy law. The journals started publishing in 2003 and have since become known for their up-to-date, valuable and engaging contents. The journals bring together academics, judges and in-house counsels and other leading professionals in arbitration: creating a network of people working in the same field, but with different interests. The OGEMID forum is used to engage in discussions between these different groups. OGEMID has managed to become the only discussion platform in the world that provides these valuable insights.

The Czech Republic has won an investment arbitration case brought by Israeli developer Asael Halevi. The tribunal dismissed all claims worth CZK 165 million (USD 7 million) and awarded the Czech Republic its costs. The investor claimed that the Czech Republic had allegedly expropriated land on the outskirts of Prague and that the Czech courts had failed to provide the investor with due process. The investor also claimed that the legislation of the Czech Republic was not stable and predictable. The tribunal rejected all claims, emphasizing, as did the Czech courts, that the land purchase contracts concluded by the investor's company were invalid from the outset. Therefore, the State could not have expropriated the land as the company had never acquired ownership of the land in the first place. The Tribunal also rejected the claim that the Czech courts had failed to ensure a fair trial. Finally, the Tribunal confirmed that the legislation of the Czech Republic was stable and predictable when, following the blocking provisions of the Land Act, the Church Restitution Act was later adopted. It's another excellent result for our arbitration team. My special thanks go to my colleagues Lenka Kubická, Tereza Ševčíková and Elizabeth Belova. We also had excellent cooperation with Alfred Siwy and Ondrej Cech from ZEILER Rechtsanwälte. This is the 32nd victory for the Czech Republic in investment arbitration. Last year, the Czech Republic successfully defended a CZK 3.6 billion (USD 164 million) investment claim in WCV Capital Ventures Cyprus Limited and Channel Crossings Limited v. This paper examines the evolving landscape of monitoring and evaluation mechanisms among investment promotion agencies (IPAs) in OECD member countries, with a particular emphasis on the integration of sustainability metrics. It explores the developments, depth and effectiveness of these monitoring and evaluation systems in measuring sustainable investments across agencies. The analysis primarily draws on data collected from a 2023 survey on monitoring and evaluation of sustainable development conducted with 33 national IPAs in OECD member countries.

This report presents a comparative analysis of investment incentives across OECD member countries and how they function within the wider context of investment promotion and facilitation. It first examines the policy objectives behind investment incentives, the types of incentives offered, their design processes and key features. It then explores the importance of incentives within investment promotion strategies, and the involvement of investment promotion agencies (IPAs) in their design, governance and management. The paper draws primarily on data collected from a survey in 2024 with all 35 national IPAs of OECD member countries.
