It was great to host ASEAN New Zealand Business Council again, this time in our Wellington office, for a lively discussion of business and trade for 2025. Kathleen Morrison, MC Partner and ASEAN NZBC Chair, said she really enjoyed the insights shared by speakers Stuart Calman, Grant Carr and Shisla Carvalho Macleod, and it was great to kick off the year catching up with friends, old and new. David Collins and Cordelia Woodhouse’s article for the Resource Management Journal (RMJ), released on Friday, delves into the Queenstown Lakes District Council v Hensman decision. In this case the High Court confirmed that the Environment Court cannot compel councils to issue a s 224(c) certificate, emphasising that a local authority’s statutory role in assessing compliance with subdivision conditions does not impose an enforceable statutory duty. The Decision also clarifies that councils can rely on general engineering conditions without needing to specify every detail of the Code of Practice, offering more flexibility in managing subdivision consents. This provides certainty for both developers and councils, and negates the need to frontload detailed engineering design for a project or require a line-by-line analysis of specific design conditions by councils.
