    Quisumbing Torres Dispute Resolution partner Jared P. Amoroso spoke at the 2024 Regional Arbitral Institutes Forum (RAIF) conference in Sydney, Australia, organized by the Resolution Institute - excellence in dispute resolution in Australia and Aotearoa. Jared discussed the development of Philippine legislation and how these have affected commercial arbitration practice and jurisprudence in the Philippines. In his capacity as president of Philippine Institute of Arbitrators (PIArb), Jared also presented to the country members of RAIF a comprehensive report on the Supreme Court rulings touching on arbitration in the Philippines, for the past 3 years, and statistics on enforcement cases in Metro Manila. Dispute Resolution associate Caryl Louise Medina helped prepare the report.    The RAIF is composed of the leading arbitral institutes in 9 countries – the Resolution Institute in Australia, Arbitration Association Brunei Darussalam, Hong Kong Institute of Arbitrators, Indonesian Arbitrators Institute, Malaysian Institute of Arbitrators, Singapore Institute of Arbitrators, Thailand Arbitration Center, and Japan Institute for International Arbitration Research & Training, and the Philippine Institute of Arbitrators. The RAIF allows its members to collaborate on common objectives, including serving the educational and social needs of the members of the arbitral institutes, facilitating the exchange of information on arbitration and promoting understanding and cooperation between their respective institutes. #disputeresolution #arbitration #philippines

    There has been an increasing emphasis on sustainability concerns for corporations in construction, engineering, and infrastructure as ESG (Environmental, Social, and Governance) is setting out to be a global priority. Given its role in molding the future of our communities beyond private interests, the construction industry has a great opportunity to lead the way in embedding ESG considerations into its business models. The first session of our Construction Law Developments in Asia Pacific seminar discussed key insights and issues arising in relation to the integration of ESG principles by corporations engaged in construction.     Construction remains one of the key drivers of the country’s economic growth. Construction is expected to continue this trend due to the Philippine government’s infrastructure programs and the increasing number of construction projects the country has been seeing. Given the value, complexity and impact of these projects, adopting an effective and enforceable dispute resolution process is more important than ever, as the risk of disputes arising from these projects increases.     As the country’s e-commerce demand rapidly continues to grow, the Internet Transactions Act of 2024 (ITA) will impact various business industries. Quisumbing Torres partners Ina Dominguez (Corporate and Commercial/M&A) and Camille Bianca Gatmaitan Santos (Dispute Resolution) recently led an internal lawyer training session on the ITA and its Implementing Rules and Regulations (ITA IRR).   Ina and Bianca discussed the new regulatory framework for e-commerce transactions, the requirements imposed by the ITA on e-commerce participants, and the impact of the law on clients belonging in various industries.     Quisumbing Torres Intellectual Property, Data and Technology Practice Group Head Divina Ilas-Panganiban shared her insights on the merger of Phil-Tower Consortium and Miescor Infrastructure Development Corporation to create one of the largest independent telecommunications tower companies in the Philippines to the Asia Business Law Journal. Divina added, “In line with the goal of beefing up our digital infrastructure, our holy grail is really to have a digitally confident population.     Firms steer creation of Philippines’ telecom tower giant https://lnkd.in/gNvjKGui Linklaters and Latham & Watkins have played advisory roles on a transaction to combine Phil-Tower Consortium and Miescor Infrastructure Development Corporation to create one of the largest independent telecommunications tower companies in the Philippines. Chrysilla Carissa Bautista of ACCRALAW, said: “Additional tower infrastructure hopefully translates to more [foreign direct investments] for the creation of data centres and [business process outsourcing companies], which are heavily reliant on internet connectivity.” Divina Ilas-Panganiban of Quisumbing Torres, told Asia Business Law Journal that as the demand for data and connectivity had surged across Southeast Asia, the telecommunications industry was witnessing emerging legal trends. Linklaters provided counsel to one of the investors, Macquarie Capital, with Niranjan Arasaratnam and Adrian Fisher leading the team. Latham & Watkins advised Global Network, one of the key investors backing the transaction. James Clayton-Payne led the team, with the support of Edward Tang.     Quisumbing Torres Dispute Resolution Practice Group associate Danielle Joanna Gaite organized a fireside chat with Joanne Lau, the Secretary General of the Hong Kong International Arbitration Centre (HKIAC) on 7 October 2024. The fireside chat was moderated by Kristine Bongcaron from Martinez Vergara & Gonzalez Sociedad (MVGS), where the event was held. The fireside chat is an initiative of the young members group of the Philippine Institute of Arbitrators (PIArb) and HK45 and catered to law students and young practitioners. During the fireside chat, Ms. Lau was able to share her arbitration career path, new features of HKIAC’s arbitration rules and career opportunities for young practitioners in arbitration. The fireside chat also gave participants a preview of what to expect for the HKIAC Conference in Manila on 8 October 2024.     Quisumbing Torres is pleased to launch the 2024 Edition of its Construction Contract Management primer. Effective dispute avoidance and resolution play a key role in construction projects, both in the public and private sectors. Given the scope, value, and impact of these projects, and the need to adapt with emerging trends and changes in regulation for corporations engaged in construction, the risk of disputes arising is likely to keep increasing. The Philippines has a unique legal framework for construction disputes, which should be considered when drafting contracts to ensure proper resolution of any arising disputes. The primer provides only a high-level overview of the key features of Philippine construction law and common issues encountered in such projects. It is intended to assist various stakeholders in managing and avoiding disputes involved in construction projects in the Philippines.     Quisumbing Torres Dispute Resolution Practice Group partner Jared P. Amoroso spoke at a panel discussion on Cross-Border Trade and Investment Disputes in Asia, at the Hong Kong International Arbitration Centre (HKIAC) Conference in Manila, on 8 October 2024. The panel was moderated by Daniel S. Hofileña of Kalaw Prasad & Hofileña Law.   When asked about how arbitration can be improved in the Philippines, Jared shared that it is important that the country’s enforcement regime be strengthened, because arbitrations involving cross-border disputes ultimately give rise to foreign and international commercial awards governed by the UNCITRAL Model Law and the New York Convention. Jared cited landmark decisions by the Supreme Court attributing a narrow definition to the “public policy” exception to enforceability of awards, and upholding the finality of awards by limiting the Commission on Audit’s power to decide money claims against the government, as examples of positive jurisprudential developments that encourage use of arbitration as a dispute resolution mechanism in the Philippines.   The HKIAC Conference was held at the Shangri-La Hotel in Bonifacio Global City, and was headlined by its Secretary General Joanne Lau and Counsel (Supervisor) Byron Perez
