Family law scholars* consider checking out this excellent special issue by Alice Margaria & Dafni Lima: "Who is family law for? Exploring legal approaches to family diversity" published in the Journal of Social Welfare and Family Law The issue includes contributions by Elise Gossens, Alina Tryfonidou, Frederique Joosten, Sanna Mustasaari, Dafni, Alice, and myself on family diversity and the law. My contribution deals with "Functional recognition and polyamory: glitters and hard truths in the O’Neill judgment". In a nutshell, in 2022 and 2023, landmark rulings in New York and New Zealand extended legal recognition to polyamorous relationships, marking significant shifts in family law. While hailed as game-changers, these decisions underscore the complexities of applying function-based recognition to non-traditional unions. The paper examines the limitations and implications of these rulings, as well as the limitations of function-based approaches to recognizing polyamory.
