HOW WILL THE UPCOMING LAW ON THE PLATFORM ECONOMY AFFECT THE TRADING ON MARKETPLACES? One of the recent articles of #TKMInternationalConsulting was devoted to the problem of violations of #IP rights on marketplaces and covered the discussion of the draft law "On the platform economy" in AmCham to form a consolidated position of its members to present to #authorities. We remind that the draft law is intended to put marketplaces and some other services into the #legal field, and this week its discussion continued at a round table organized by the Association of #Digital Platforms uniting Wildberries, Ozon, Yandex, Avito and SberMarket. Today we present more in details some of the main regulatory measures proposed for implementation: ⚖️ In case the goods are offered by a foreign partner, #marketplaces (operators) are obliged to include in the product card the specifics of its purchase, and also to provide the technical possibility for placing permits, licenses, certificates or other documents of the seller. 💡  If a violation of exclusive right to the result of intellectual activity or to the means of individualization is detected, the copyright holder has the right to file a statement about the illegal placement of the card to the operator. However, there are no provisions directly defining the #liability of the platform operator for the violation of #IPrights, and the procedure for filing and considering a statement about the violation of IP rights is not established. ⚡  It is proposed to oblige marketplaces to block the sale of unmarked goods subject to mandatory marking in accordance with the decree of the Government of the Russian Federation. In daily activity while checking the documents for the goods provided by sellers on marketplaces, #TKM specialists often find "empty" documents where the required information and seal are missing. Also, when trying to sell a product that does not match the description or is a fake, sellers can attach scans of other people's documents. Unfortunately, not all consumers know what to look for when checking the product and the seller before making purchase. To conclude, the measures considering for implementation within the #draftlaw are aimed to prevent the #fakes distribution. NEW WAY OF BYPASSING ANTI-COUNTERFEITING LAW A recent trend in product copying is #pingti, which originates from Asia and is gaining popularity in the world. The phenomenon is also known as #dupes in Western markets and means the affordable alternative to the luxury products and expensive services. One of the principal features of these products is their high similarity to popular #luxury brands’ items, but with no logo and/or removable parts of the item. This is explained by the fact that unlike deceiving counterfeits, Pingti are high-quality alternatives reflecting similar spirit and essence of famous brands, but more affordable. Not only bags, clothes or footwear have Pingti analogues, but perfumery, cosmetics and even healthcare products are involved in this trend as well, offering the competitive analogues of the well-known brands by attractive prices. Some of the brands affected by Pingti trend are Hermès, Lululemon Athletica, Nike, Prada, Bottega Veneta, and others. The lawyers of #TKMInternationalConsulting emphasize, that the #legislation of different countries applies variable regulation and liability in terms of infringements of IP rights. In Russia exists a #legal concept of “confusing similarity”, which allows to recognize the fact of #copying associated with misleading the consumer and #copyrightinfringement. If the #confusingsimilarity is settled #TKM lawyers achieve the financial #reimbursement in favor of the copyright holder in court. 5TH INTERNATIONAL FORUM ON FOREIGN ECONOMY: "CHALLENGES AND SOLUTIONS FOR BUSINESS - NEW HORIZONS OF GROWTH" On November 21-22, 2024, the 5th International Practical #Forum was held at the Mosstroyinform venue and at the #Plekhanov Russian University of Economics, which brought together more than 17,000 participants from eight countries. TKM AND AMCHAM DISCUSSED CURRENT PRACTICE AND LEGISLATIVE INITIATIVES ON COUNTERFEIT CONTROL ON MARKETPLACES The Russian #ecommerce market is showing dynamic growth, notably the largest multi-category marketplaces, where the turnover of goods has grown by 60.9%, according to Infoline Analytics. The number of sellers and goods on the online platforms is increasing daily, but the consumers should not trust all the products offered. #TKM #Digital Department team is convinced that the distribution of counterfeit goods on #marketplaces is gaining momentum, and #copyright holders are suffering from the #commercialactivity of unscrupulous sellers. On November 21 this problematic was raised within the working group of the American Chamber of Commerce in Russia (AmCham). TKM experts presented the bill “On the platform economy” along with the current practice of punishment for violations in terms of counterfeit distribution on marketplaces. In this matter, lawyers and representatives of copyright holders paid special attention to one of the provisions of the bill that if the marketplace is aware of the violation, but does not take measures to stop it, the blame still falls on it. 32K LITERS OF FAKE COCA-COLA SEIZED IN THE MOSCOW REGION During daily operational activities jointly with law enforcement agencies, #TKMInternationalConsulting detects the sites of production, storage and sales of counterfeit products. Nowadays, the infringers in Russia falsify not only packaging, trademarks and brand identity, but also markings, excise stamps, and other means of identifying authenticity. Thus, it is vital for brands to ensure not only the minimal legal protection of their #IP rights, but enforce the #anticounterfeiting activity on the ground, as serious threats actually exist. In June 2024, #TKM issued an article about the filing of applications to the Federal Service for Intellectual Property of the Russian Federation (Rospatent) for the registration of three trademarks of The Coca-Cola Company 👉 https://lnkd.in/ek2GYMmP Today, 6 months after, we witness the efficiency of that act, as the #IPrights of the brand are infringed in a large scale. Recently, LEAs detected an #illegal workshop for the production of Coca-Cola and Pepsi in the city of Khimki with 32K liters of #counterfeit drinks, poured into 16K two-liter bottles with stickers of the brands mentioned. In addition, the police found #equipment for bottling, capping and packaging products. Currently, LEAs are deciding whether to initiate a case under the article "Illegal use of means of individualization of goods". #TKMInternationalConsulting specialists draw the attention of copyright holders to the fact that in the conditions of suspension of activities or complete withdrawal from the Russian market, many brands become even less protected, since they neglect to renew the registration the ™s belonging to them. Upon expiration of the registration in Rospatent and in the #customs register (TROIS), the protection of the ™ in Russia ceases. Competitors can take advantage of this and register even a world-famous brand name for themselves. Also, the lack of registration of a ™ will not allow achieving the maximum possible degree of liability and financial compensation for illegal use of a ™.
