10 December 2024 - Universal Declaration on Human Rights’ 76th birthday 🫶 I wanted to reflect on the subject that is closest to my heart – the nexus between business and human rights When I started researching the topic in 2003 with Salil Tripathi and had dialogues with Shell in Nigeria on the devastating environmental damage caused by oil spills which affected peoples’ right to health the company frowned upon questions on their adverse impact on human rights. Since 2011 we have the UN Guiding Principles for Business and Human Rights (#UNGPs), today widely regarded as the authoritative guidelines for companies’ respect for human rights. It refers to the #UDHR as one of the core human rights instruments. Making respect for human rights operative for businesses it requires companies to identify, prevent, mitigate and account for adverse impacts on human rights. The OECD has developed their 6-step interpretation (OECD Guidelines) of the UNGPs and those are very much relied upon by companies for policies and practices. These two have made waves in the business community. Policy commitment is the first step to implement the UNGPs and the OECD guidelines. A recent review by the World Benchmarking Alliance identifies a positive trend in companies' committment to the UNGPs or the OECD Guidelines for Multinational Enterprises in policies as that has increased by 18% to 44% of all companies assessed since the first review in 2017. In terms of hardlaw that cements businesses’ respect for human rights we have national legislation in France, Germany and Norway that incorporates requirements for businesses to conduct human rights due diligence (HRDD). Soon we will have 27 in Europe. In 2024 we saw a monumental change with the adoption of the EU's the Corporate Sustainability Due Diligence directive (#CSDDD). This gamechanger legislation puts the EU in the driver’s seat for increased respect for human rights and the environment. From 2027 onwards some 5600 in-scope companies need to comply and enhance its work on the respect for human rights. And tens of thousands of companies will also need to do so as they will be asked how they respect human rights and mitigate adverse impact as suppliers to those 5600. I see two positive trends here: the respect for human rights is becoming mandatory through legislation, and the topic is broadened with topics such as living wage, living income, and just transition. We see an increased demand for how to conduct HRDD, and the demand will increase exponentially as we get closer to 2027. So we have heaps of work in front of us. Especially as the goal of the CSDDD is not to have perfect value chains, or chains of activities, from the start but rather set processes in motion for a successive improvement over time by using risk-based due diligence.
