Navigating the complexities of personal data protection often involves more than just black-and-white decisions. In the case of Martin Piper v Singapore Kindness Movement [2024] SGDC 292, our client faced a complaint involving the disclosure of personal data. The Court examined whether our client had breached the Personal Data Protection Act 2012 (PDPA) and if the claimant suffered any direct loss or damage as a result. After reviewing the key provisions of the PDPA, the Court found no breach as the claimant was deemed to have consented to the disclosure during the investigation. Additionally, there was no proven loss or damage from the incident. 🔊 Update on the Maintenance of Racial Harmony Bill in Singapore In January of 2025, the Maintenance of Racial Harmony Bill was tabled in Parliament. The primary objective of this bill is to create a cohesive multi-racial society by addressing threats to racial harmony, which include hateful speech, bigotry, and racism. This goes beyond the existing Penal Code offences that address threats to racial harmony and ports them over into this new bill. Key measures of this bill include: ▪ Inciting enmity or hostility against a racial group. ▪ Insulting or abusing someone based on race. ▪ Inciting violence on the basis of race. In addition to these key measures, the bill also introduces safeguards to prevent race-based entities from being used as vectors of foreign influence and a restraining order regime to deal with content prejudicial to racial harmony. "There are many types of cryptocurrencies, and the evidence for each claim process may differ," Jansen Chow, Co-Head of our Fraud, Asset Recovery & Investigations practice at Rajah & Tann Singapore, shares with Lianhe Zaobao 联合早报 in a recent article on valuing claims in cryptocurrency litigation. Despite the public and traceable nature of blockchain transactions, identifying ownership remains challenging. Unlike traditional assets, which typically have third-party ownership records, volatile assets like blockchains and cryptocurrencies require new valuation methods. The Singapore courts recognise that traditional valuation methods are no longer applicable and have shown flexibility in adopting new methods that better reflect actual losses in cryptocurrency-related cases. Organisations in Singapore are calling for caution over the use of DeepSeek, even as they eye the cost-saving promises of the Chinese generative AI (Gen AI) model. Commenting on the R1 model which shook the tech sector, Rajesh Sreenivasan, Head of Rajah & Tann Singapore’s Technology, Media & Telecommunications Practice, shares with The Straits Times, “It might be open-source, but this alone doesn’t protect corporate users from potential legal risks.” Our firm has invested heavily in deploying enterprise editions of Gen AI tools to ensure that data used is kept within our systems, which Rajesh highlights as “especially important for regulated firms”. 🔊 Important update on Solar Photovoltaic Installation for Self-Consumption in Peninsular Malaysia. Solar power continues to play a pivotal role in the Malaysian government's efforts to support the energy transition and achieve the goals of increasing the country’s installed renewable energy capacity to 70% and achieve net-zero emissions by 2050. The country’s Energy Commission recently published the Guidelines for Solar Photovoltaic Installation for Self-Consumption in Peninsular Malaysia, which came into effect on 1 January 2025. The objectives of the Guidelines are to: ▪ Provide for the types of solar photovoltaic (PV) installation for self-consumption. ▪ Prescribe the conditions for the installation of solar PV systems for self-consumption. ▪ Set out the requirements and obligations on an electricity utility company (EUC) and any person who installs, owns, uses, works, or operates the solar PV installation.
