As of 1st December 2024, #Ukraine has implemented new rules for #reserving employees under martial law, with updated criteria for recognising critical enterprises. The key changes include mandatory salary thresholds (approx. $500), stricter verification processes, and renewed requirements for deferments. Previously granted deferments remain valid but are subject to potential cancellation under specific conditions, such as losing critical enterprise status. New deferments are valid for up to 12 months, with a cap on the number of employees reserved per enterprise. Applications shall be submitted through the Diia platform for swift, automated processing. The Prozorro.Sale electronic trading system in #Ukraine facilitates the competitive sale of state-owned enterprise property through #auctions. Participants bid via authorised electronic platforms offering various features. Before an auction, the organiser publishes a detailed announcement, including property details, starting price, and participation requirements. Potential buyers must pay registration and guarantee fees and meet specific criteria outlined in the announcement. Auction rules allow changes to the starting price or other details but prohibit discriminatory requirements. Participants can appeal against auction terms if they find them unreasonably restrictive or violate their right to bid without valid grounds. To dive deeper into the rules and procedures of the Prozorro.Sale system, read our full article here: https://lnkd.in/d9kBS8Qi #dlfukraine #dlflawyers #dlfpublication #dlfnews #prozorro #consultingfirm

Late September 2024, the procedure for #payments to families of foreign citizens who served in Ukraine’s #military and were either killed, went missing, or were taken prisoner was changed. This procedure provides clear steps for obtaining financial support, which includes visiting the Ukrainian Embassy for identification and verification of family members’ legal capacity. A representative in Ukraine, designated through a power of attorney, is required to submit the necessary documents to the Ukrainian authorities. To facilitate payment, the representative must open an account in a public sector bank in #Ukraine and deliver a comprehensive set of documents. Once submitted to the military authority or the respective military unit, these documents allow for the processing and disbursement of payments to the family members of the foreign soldiers. Ukraine's energy sector faces a critical need for equipment and services to restore infrastructure damaged by russia's agression. To address this, public #procurement methods are being used extensively, including open #tenders, framework agreements, and direct contracts. The #ProZorro system plays a central role, allowing competitive bidding and ensuring transparency, especially with "eurotenders" that streamline procedures. Additionally, the government has introduced simplified regulations for energy services procurement under martial law to expedite processes and improve efficiency. International aid, especially through the Ukraine Energy Support Fund, has been crucial, with USAID’s Energy Security Project coordinating competitive procurements. This support highlights a coordinated effort to rebuild and modernise Ukraine’s energy #infrastructure. Two days of inspiring events and interesting discussions. Many foreign businessmen from around the world working in the defense and technology sectors, interested in entering the Ukrainian market or already present here. The Defense Tech Valley Investment Summit brought together hundreds of participants and startups developing creative solutions that can be applied on the battlefield today. During the past two and a half years of full-scale war, 💙 Ukraine 💛 has managed to create and organize a platform where new solutions are actively discussed and projects are implemented. This has been achieved, among other things, by deregulating the sector, with changes to dozens, if not hundreds, of regulations. Promising start-ups are supported by public and private grants. An appropriate ecosystem has been created and information on Ukrainian manufacturers, including components, has been systematised. Foreign manufacturers can test their equipment and technologies on the battlefield and get quick feedback from our soldiers. On the picture ⬇️ you can see some statistics and results of the hard work that allows us to fight a 💣 monster on equal terms. ☝ Some insights from our Minister Mykhailo Fedorov: ▪️ Ukraine already has private missile manufacturers; ▪️ Ukraine now produces the largest number of artillery systems in the world; ▪️ In 2024, Ukraine ordered 1.6 million drones from Ukrainian manufacturers. Today's production capacity of Ukrainian manufacturers is about twice as large. most likely, it will be necessary to allow the export of drones. eMarkus Dold

The Ukrainian parliament recently passed a law allowing foreign citizens defending Ukraine’s territorial integrity to obtain temporary residence permits, #immigration permits, and Ukrainian citizenship. The law, effective from 24 November 2024, provides a simplified path to #citizenship for those serving in the defence forces of Ukraine, as well as their families. Consideration of applications from russian citizens will resume one year after martial law is terminated, with exceptions for those with significant merits to #Ukraine or serving its national interest. On 3 September 2024, Ukraine implemented a law that simplifies the registration and termination of branches and representative offices of foreign legal entities, delegating the procedures to state registrars, increasing the accessibility of registration services, and reducing document review period to 5 business days. The #liquidation of a foreign legal entity's #branch or representative office can be initiated by the legal entity itself or by court decision, involving steps like notifying the registrar, satisfying creditors' claims, and updating the Unified State Register. For foreign banks, specific conditions must be met for opening a branch, including accreditation by the National Bank of #Ukraine and meeting capital and compliance requirements. On 2 September 2024, a new law came into effect in #Ukraine to simplify business operations during martial law, aiming to adjust to the current circumstances of war and to facilitate economic growth. The law allows business entities to submit declarations in place of #permits or #licences, which are valid for the duration of martial law and until the end of the calendar year in which martial law ends, with a minimum period of 3 months. Declarations can be filed from any location, and previously issued permits do not need to be renewed during martial law. This, however, does not apply to certain #business activities (due to national security matters, environmental issues, etc.). The law also suspends scheduled inspections by licensing authorities and automatically extends previously obtained permits. 💬 What do you think about this new development? Could this initiative impact commercial demining services? How do you see this affecting the private sector? 💡 The Ukrainian Government has announced that state-owned enterprises now have the right to collect funds from charitable donations via the National Bank of Ukraine for demining efforts. 🚜 Ukroboronprom, for example, has the technical capabilities for mine clearance.
