A recent change to the law means that journalists and legal bloggers are now allowed to report on family court cases across England and Wales. The change was approved by the Ministry of Justice (MoJ) and came into force on 27 January 2025. The rollout is staggered, and transparency will first apply to public law – care cases – then to private law, where parents are separating, and lastly to magistrates' courts. Family courts have the greatest powers to intervene in private family lives. They determine whether children should be removed from their parents or which parent children should live with. Grandparents can apply for access to their grandchildren if the relationship with the child’s parent or guardian has broken down. At the end of last year, pilot schemes for tougher domestic violence orders were announced. The pilots for enhanced domestic abuse protection notices and orders (DAPNs and DAPOs) were legislated for by the previous government in 2021. They will be trailed by Greater Manchester, three London Boroughs and the British Transport Police. There will be further pilots in Cleveland and North Wales in early 2025 before a national rollout. Any court can impose the new orders, and powers can be brought together in other protective orders to provide “flexible and long-term protection” for victims.
