We are a leading European IP patent, design and trade mark firm recognised throughout the IP world for its commercial awareness and commitment to clients. Our clients operate across a wide range of industries and are based both in Europe and elsewhere. We act for a variety of clients, from individuals and small start-up companies through to academic institutions and multinational enterprises. We have been established in the UK since 1894, but now benefit from having multiple offices across Spain and Germany. Our teams in our UK, German and Spanish offices work together both closely and collaboratively and our strong presence across jurisdictions both inside and outside of the EU means we are able to handle work at a national, European regional and international level.     In a recent UPC case, the Court granted a Defendant’s request to extend the deadline for filing a defence until after an EPO Board of Appeal decision. This demonstrates the UPC's pragmatic approach to parallel #EPO and #UPC proceedings, aiming for efficiency while respecting all parties' rights. The decision highlights the continuing significance of #EPOopposition and appeal processes in #patentlitigation.     The #EUAIAct, which we previously reported on (https://lnkd.in/eA2Uh4cS), and which entered into force on 1 August 2024, with a plan for staggered implementation of its rules has now implemented the first batch of prohibitions as per the Act.. On 2 February 2025, prohibitions in line with Article 5 of the Act have come into force. Along with these prohibitions, rules around AI literacy have also started to apply. Some of the prohibitions now in force are for AI systems that: - deploy subliminal techniques beyond a person’s consciousness to change the behaviour of a person or a group of persons by appreciably impairing their ability to make an informed decision, and which are likely to cause significant harm - create or expand facial recognition databases through scraping facial images from the internet or CCTV footage - infer emotions in the workplace or educational institutions - evaluate or classify people based on their social behaviour or personal traits leading to unjustified detrimental treatment to certain people/groups - predict a person’s risk of committing a criminal offence by profiling - categorise people using biometric data to deduce their race, political opinions, trade union membership, religious or philosophical beliefs, or sexual orientation. Some exceptions are present including one for remote biometric identification systems in public spaces for certain law enforcement purposes – such as searching for missing persons, assessment of the involvement of a person in a criminal activity, prevention of genuine and foreseeable terrorist attacks. Failure to comply with these prohibitions will result in companies being subject to a fine of up to 35 million euros or 7% of its total worldwide annual turnover for the preceding financial year, whichever is higher. Given the steep fines, it is vital that companies operating in the EU check their AI practices and keep up to date with the upcoming implementation of the EU AI Act. The next update with relation to the EU AI Act is expected to be around in May 2025 with the Codes of Practice being released, followed by the next set of prohibitions in August 2025.   • The EPO, in connection with the International Energy Agency (IEA), has published a study mapping #patentfilings relating to #inventions for #electricitygrids against filing date since the turn of the century. The study contains some interesting statistics, some key highlights include that: - perhaps not surprisingly, most growth in the last decade has come from #smartgridtechnologies; - in the last few years Chinese applicants have brought their filing numbers in this space onto the same scale as European applicants; and - it is clear from the study that startups in this sector are prioritising and understanding the benefits of patent protection. Technological developments in this area are essential to meet the ever-more-urgent need for grids that connect often remote sources of renewable energy with the cities and factories that consume that energy, and this is clearly reflected in the number of international patent families being pursued.     Did you know that geographical indications (GIs) protect products linked to specific regions, such as Scotch whisky, Stilton cheese, and Melton Mowbray pork pies? These products carry a unique identity tied to their geographical origin and their protection is critical for brand owners. Post-Brexit, the UK operates a dual approach to GI protection, meanwhile, the EU is expanding GI recognition to cover craft and industrial products from December 2025. Brand owners should ensure compliance with GI regulations before launching products and seek expert IP advice to protect their valuable intellectual property.   • A recent UPC ruling confirms its "long arm" jurisdiction over UK parts of European patents, even with the UK outside the EU. The court can hear infringement cases but cannot rule on UK patent validity.
