The first concern of the court is the child’s welfare. The Children Act 1989 provides a list of considerations for the judge who has to decide the case, which helps guide them in making a decision: 🙏 The wishes and feelings of the child concerned. 🧒 The child’s physical, emotional and educational needs. 🧠 The likely effect on the child if circumstances changed as a result of the court’s decision. 👶 The child’s age, sex, background and any other characteristics that will be relevant to the court’s decision. 🤕 Any harm the child has suffered or may be at risk of suffering. 👪 The capability of the child’s parents (or other relevant people) to meet the child’s needs. 💪 The powers available to the court. The court must also be satisfied that making an order is better for the child than not making an order at all. By partnering with support organisations and charities – we can ensure that our clients have access to additional support during and after their legal case has been resolved. It also ensures the users of these support organisations have easy access to legal support should they need it. Furthermore, our 1-1-1 method guarantees that 1% of our profits are shared with the organisations, 1% of all work is pro bono for our clients and 1% of all employee time is paid volunteer time for the support organisations. Part of our 1-1-1 support includes running training sessions for the staff of support organisations to ensure they can feel confident in a legal setting. In most cases, decisions can be taken by one Parental Responsibility holder. It is not always necessary to seek the consent of another person if they have Parental Responsibility. For example, a school may only need consent from one person with Parental Responsibility to take the child on a school trip. If the other parent strongly objects, they could seek a Prohibited Steps Order from the court to prevent this from taking place; the court will decide what they believe is in the child’s best interests. Where there is a major decision to be made about the child’s life, all those with Parental Responsibility will need to agree. For example, if one parent wants to change the name of the child, move abroad with the child or have the child put up for adoption, all those with Parental Responsibility must agree.
