The economic and social cost of reoffending in England and Wales is approximately £18 billion per year, and only 17% of ex-offenders secure employment within a year of their release from prison. Prison reform is at the heart of the government’s strategy and companies are increasingly being asked what role they are going to play. This event will explore how we can challenge current perceptions about employing ex-offenders and how businesses can equip themselves to create opportunities for them. In one of the first examples of the courts exercising their newfound case management powers under CPR 1.4 and CPR 3.1, the decision in DKH Retail Ltd and others v City Football Group Ltd [2024] EWHC 3231 (Ch) provides insight into the readiness of the courts to exercise those powers to order parties to engage in alternative dispute resolution. In this case, the court determined that irrespective of (i) the imminency of trial; (ii) the significant fees incurred by both sides; and (iii) the defendant’s wish for the matter to be judicially determined, it would be appropriate to order the parties to mediate on the basis that mediation was deemed to have a reasonable prospect of success in settling the dispute, with both parties’ positions having been crystallised through pleadings and witness statements, and both parties therefore having a clear understanding of each other’s position. Interestingly, in the postscript to the judgment, it was confirmed that the parties had settled their dispute. #ADR #disputes
📢 Alternative dispute resolution takes centre stage Sandi Simons and Maninder Goraya have been published in the Solicitors Journal. Their article discusses amendments to the Civil Procedure Rules stemming from the decision of the Court of Appeal in the case of Churchill v Merthyr Tydfil. Effective from 1 October 2024, courts can now mandate ADR, aiming to streamline dispute resolution and potentially reduce litigation costs. These changes reflect a growing trend in English law to promote mediation and other ADR methods.
