Who gets to keep the pets after a divorce? An often overlooked aspect of separating couples and how they deal with the financial breakdown of their relationship, is what might happen to the family pets. This can especially become an issue with a well beloved cat or dog, and one party’s keeping a pet can often cause real anguish to the other, if agreements cannot be reached for the care of a family pet to either be shared, or for arrangements made for the pet to spend time with both parties. It must be made clear however, we are talking about the family pet here: not children. It may seem harsh, what can be a much loved member of the family will be treated as chattels by the court, in much the same way as furniture or other belongings maybe. It is always better if at all possible to reach an agreement as to what fate will await the family’s pets, and more creative means for settlement such as mediation is an appropriate avenue to pursue. There may come, however, be occasions where the family’s dog or dogs may in themselves be valuable assets: in particular if they are pedigree dogs, and the parties would supplement their income by breeding from them. There have been cases where this can provide a useful second source of income and the dogs themselves can be very valuable, if they are still of breeding age. In those circumstances, the court would treat the dogs and their income generating potential as assets of the marriage rather than simply chattels. However, in the great many cases the family pet will have to be dealt with in much the same way as any other stick of furniture or to the family home. As I have mentioned above, any dispute concerning them should be kept out of the court arena, to be dealt with more effectively, quickly and hopefully by consensus.
