    It has been drawn to my attention today that the Planning Inspectorate now include the following text in their automatic response to emails: "We are currently experiencing delays in processing and matching appeals with a suitable Inspector. Please therefore be advised that we will not be able to provide a response to emails chasing for a start letter or site visit as this will enable us more time to process the casework." I have also seen recent anecdotal evidence of planning appeals which would ordinarily have been allocated to the inquiry procedure being allocated to the hearing procedure instead. Many of us predicted months ago that PINS would, without additional resourcing, struggle to deal with the uptick in planning appeals (and indeed Local Plan EiPs) that would flow from the changes in the NPPF. It seems this is already happening. The answer is not to funnel appeals that deserve to be considered at inquiry into the hearing procedure where the %age success rate is markedly lower (hence why most developers/promoters want an inquiry for their appeals) - thus undermining the 'growth agenda'. Nor is it to mask the true extent of delays by measuring performance against targets by reference to the start date, which may come several weeks (or more) after an appeal is submitted. It is to resource PINS properly, including considering using the existing, unused power to charge appeal fees e.g. for an optional 'bespoke procedure' for those appellants willing to pay to get the procedure they want and the dates they want. Every developer/promoter I've spoken to about this has unhesitatingly said 'Yes' when I asked if they'd pay a £10K appeal fee to get those things in return. Multiply that by (say) 200 appeals and that's £2m extra for PINS. Without the need for any legislation. There are some who say that would lead to an unfairly two tier appeals system. I disagree. You can already pay extra to get your passport in a day rather than in weeks. The independence of decision-making would still be preserved. The system I propose would be entirely lawful and in keeping with natural justice & procedural fairness. In an ideal world, there may be more perfect ways to resolve the backlog and deal with the forthcoming deluge of appeals, but we don't live in ideal world - rather one where the perfect is the enemy of the good. Please do not take this post as a criticism of PINS or the draft new NPPF. I have a lot of respect for both of them. It is more of a call to arms to Ministry of Housing, Communities and Local Government to take the easy win. #planning #housing #nppf Have We Got Planning News For You
