This week’s decision to allow accredited journalists to report from family courts marks a major moment for the justice system in England and Wales. Sir Andrew McFarlane has called it a “watershed” moment, and it is easy to see why. For years, the inner workings of family courts have been shielded from public view, and while journalists have been able to attend hearings since 2009, they have had no real ability to report on them. Greater transparency could bring much-needed clarity to a system that is often misunderstood. Family court decisions can have life-changing consequences, such as determining a child’s care arrangements or removing parental rights. Allowing the public to better understand these processes may help build trust and accountability. However, this new level of access isn’t without its risks. Even with anonymity, the families involved may feel exposed, adding further stress to what is often an already traumatic experience. Misinterpretation by the media also raises concerns about the public forming incorrect conclusions. I appreciate the balance that must be struck here. Transparency is vital for a fair and trusted system but safeguarding the privacy and dignity of those involved is equally important.
