Last week, Menzies' Saumyanil, Head of Transfer Pricing, attended the 2025 WU Global Transfer Pricing Conference, having interesting discussions with the policy makers from the OECD, United Nations, HMRC and other tax authorities. A great opportunity to discuss Transfer Pricing Developments around the world 🌍 #TransferPricing #MenziesLLP
I am currently having fun in Vienna (yes it’s cold!) at the 2025 WU Global Transfer Pricing Conference. Interesting technical discussions with fellow advisors, policy makers from the OECD, United Nations and various tax authorities (including HMRC). The highlights so far for me are the following: - OECD is currently working on further guidance on intra-group services. They have also started working on a new guidance on global mobility and impact on/of TP. We will be keenly watching out for these two guidances coming out possibly later this year. - HMRC is increasingly focusing on APA and MAP. A clear indication is (consistent with my recent practical experience) more MAPs are being accepted, as long as the application has merit and is comprehensive. - HMRC is interested in accepting more bi and multilateral APAs, but the focus is on ‘complex’ transactions and arrangements. ‘Complex’ is obviously a subjective word (although we can guess which transactions or arrangements could be termed as such) and I have recently seen some transactions have been accepted in the APA programme which could be construed as ‘not complex’. I think the important point here is how the word ‘complex’ is being defined - it might not necessarily just mean technically complex arrangement, but a transaction with ‘substantial’ tax exposure or the other jurisdiction is deemed as litigious or aggressive. Anyway the fun part for me is TP landscape is getting more exciting with so many developments. And we, at Menzies LLP, are on top of all the changes and are keen to support our clients. #transferpricing #tp Menzies LLP HLB International

HM Revenue & Customs has retreated on plans to close a national insurance tax ‘loophole’ for LLPs, a move likely to be welcomed by many law firms fearing backdated bills. Peter Noyce, Partner, Menzies LLP, comments in The Law Society on welcoming the move, and how the worded guidance and legislation can bring others into play rather than on target.
