  • Barrister Henry Reid, led by Alexandre Philippe Haines of 4 Pump Court, represented the applicant at the final hearing in November 2024 in Jeddah, Saudi Arabia, following the success of the jurisdiction and admissibility judgment handed down in February 2024 (Decision No. 2024/04). Henry, having successfully appeared alone in the Jurisdiction and Admissibility judgment, co- represented the applicant against the Islamic Corporation for the Development of the Private Sector (“ICD”) in a termination case in before the IsDBGAT sitting en banc. The Applicant challenged the Respondent’s decision to terminate his employment as the Director of the Internal Audit Department. The Tribunal agreed with the Applicant that the termination had been effectuated by ICD’s CEO and that the decision “was, for all intents and purposes, an administrative decision and not a ‘governance’ decision”. In its judgment, the Tribunal also addressed ex parte filings and the production of documents. The Tribunal awarded damages and costs against the Respondent.   • The High Court of Justice has handed down judgment in the case of Agrofirma Oniks LLC & Agro UG V LLC v. ABH Ukraine Limited & Others. Outer Temple's Henry Reid, led by Michael McLaren KC of Fountain Court, successfully acted on behalf of the claimants in a Part 11 jurisdiction challenge brought by the Third Defendant, the oligarch Mr Mikhail Fridman. The case revolves around a dispute concerning Loan Participation Notes (LPNs) in which the Claimants, Agrofirma Oniks LLC and Agro UG V LLC are agribusinesses and clients of the fourth defendant, PJSC Sense Bank (formerly PJSC Alfa Bank Ukraine). A key issue in the case concerned the service of legal proceedings on Mr. Fridman. The claimants attempted to serve him at his UK residence, Athlone House in London. However, due to UK sanctions imposed on him in March 2022, his assets were frozen, and his leave to remain in the UK was cancelled, preventing him from returning to the country having departed in October 2023. The claimants argued that despite this, Athlone House was still his usual or last known residence. Justice Bryan ruled in favour of the claimants on the issue of service, holding that Athlone House in London remained Mr. Fridman’s “usual residence” despite his physical absence. Service was therefore deemed valid, meaning the proceedings against Mr. Fridman could continue in the English courts. The court also rejected Mr. Fridman’s jurisdiction challenge, confirming that he remained within the jurisdiction of English law for the purposes of this case.   • The Royal Court of Guernsey recorded its highest ever personal injury damages award in the case of JG v AC. Outer Temple's Gerard McDermott KC and Ian Denham, instructed by Stewarts, represented JG who sustained a complete spinal cord injury, resulting in tetraplegia. In November 2021, JG was a rear seated passenger in a VW Golf that was travelling in excess of the 25mph limit on a narrow road in Guernsey. The vehicle lost control and clipped a wall on the side of the road colliding with a pole, before being flipped upside down and coming to a stop on its roof. JG sustained catastrophic and life-changing injuries, including a C7 complete spinal cord injury following an unstable fracture to his C6 vertebrae. He is now dependent on full-time carers to meet his personal needs and a wheelchair for mobility. JG sought the assistance of the International Injury team at Stewarts. Partner Chris Deacon led JG’s claim alongside senior associate Rebecca Huxford. The claim presented a number of challenges of the utmost complexity. At a Joint Settlement Meeting, JG’s legal team reached agreement on a final settlement of £23 million after issuing court proceedings on a protective basis in the Royal Court of Guernsey.   • Barrister Oliver Lawrence successfully represented the Defendant before HHJ Watson (sitting as a High Court Judge) in Birmingham. The application for a non-compete injunction was brought by a catering company against one of its former managers. The injunction sought would have prevented the employee from working for a competitor for six months after the termination of his employment. The main issue in the case was whether the non-compete covenant was drafted too broadly to be enforceable. It was found to be too wide. Delay was also found to be a significant factor against the grant of an injunction. The length of the period of pre-action correspondence was not a sufficient excuse.   • Clinical Negligence specialist Ben Bradley successfully represented the Claimant following a 6-day trial before HHJ Kelly (sitting as a High Court Judge) in Birmingham. The trial revolved around a PEG Procedure performed by a Consultant Gastroenterologist at the Good Hope Hospital in Sutton Coldfield in 2016. The Claimant had a complex pre-existing medical history, having suffered congenital cerebral palsy from birth. Following the index PEG procedure, she became unwell. It was alleged that the PEG medical device had been fitted with too much tension between the 2 fixation devices which lay against the skin and the inside of her stomach respectively. This resulted in the necrosis and breakdown of the skin, leading to the peritonitis. The trial judge broadly rejected the evidence of fact given by the Consultant Gastroenterologist for a number of detailed and comprehensive reasons given in the judgment. She duly held that he had acted in breach of duty. Ben Bradley was instructed by Leanne Atkinson of Irwin Mitchell LLP, Birmingham. The new regime will have particular impact on ADGM Financial Services and other regulated businesses, which have to implement comprehensive written procedures prior to the end of May 2025.  PETER was also able to draw on his experience of whistleblowing claims in DIFC and UK, including his involvement in Khalifa v SWIFT, the first whistleblowing claim to be brought before the DIFC Courts.
