  • Barristers James Leonard KC and Oliver Powell of Outer Temple Chambers, instructed by Simon Belfield of DWF, appeared on behalf of the Maritime and Coastguard Agency (‘MCA’), at Southampton Crown Court. After a 4 ½ week trial, a jury unanimously convicted Intrada Ships Management Ltd of failing to take all reasonable steps to secure that a ship was operated in a safe manner. On 13 December 2021, the Scot Carrier, a UK registered general cargo vessel, and the Karin Høj, a Danish registered barge, were in the Baltic Sea just off the South coast of Sweden. On arriving at the southerly end of the TSS, the Scott Carrier turned 50° to starboard to head towards its next waypoint. The Karin Høj maintained her speed and course as she was heading for port on all but the same course to the southwest. In consequence of this manoeuvre, the Scot Carrier’s bow struck the Karin Høj amidships on the port side, causing the Karin Høj to roll and immediately capsize. The two crew members of the Karin Høj, the Master Erik Jensen and the mate Per Hartmann Christensen, were both were killed as a result of the collision. Mr Mark Wilkinson was the Second Officer (‘2/O’) on board the Scot Carrier and the Officer of the Watch at the time of the collision. Wilkinson, was significantly above the legal alcohol limit. On 16 June 2022, he pleaded guilty before the Danish courts to gross negligence manslaughter and failing to render assistance to those in peril at sea. On 17 July 2023, Captain Sam Farrow pleaded guilty to failing to operate a ship in accordance with the safety management system on the basis of which the Safety Management Certificate was issued. On 10 December 2024, Intrada Ships Management Ltd was convicted of failing to take all reasonable steps to secure that a ship was operated in a safe manner.   • Earlier this week, a Disciplinary Tribunal upheld three allegations of professional misconduct against Navjot ‘Jo’ Sidhu concerning a young woman, finding that he used his status as a highly respected senior lawyer to sexually harass her. Fiona Horlick KC of Outer Temple Chambers acted for The Bar Standards Board. Following a seven-day hearing in November, the tribunal’s findings were handed down earlier this week. A Disciplinary Tribunal with a five-person panel found three charges of professional misconduct to be proven against Mr. Sidhu concerning inappropriately initiated sexual contact with an aspiring lawyer. In an opening statement delivered at the start of the hearing, Fiona Horlick KC, appearing for the Bar Standards Board (BSB), said that Sidhu, a former chair of the Criminal Bar Association, had been accused of “predatory behaviour” and had used his “pre-eminent position to manipulate vulnerable young women who were considering a career at the bar in order to gain sexual favours”. In her summary the chair of the panel, Her Honour Janet Waddicor, said his invitations to the young woman was “an invitation of a sexual nature and which he knew or ought to have known was inappropriate and unwanted”. Following judgment, Fiona Horlick KC, for the Bar Standards Board, applied for an interim order, which was agreed by the panel that Sidhu be suspended from practice until sanctions are decided.   • Andrew Axon was recently invited by the #Otology Department of the Royal Society of Medicine to their latest CPD event on Controversies and Management Dilemmas. Andrew's lecture focused on how to avoid litigation in pushing boundaries. He discussed the complex area of clinical intervention outside the normal evidence-based safety net, what to consider when trying to help patients struggling to find a symptom solution, and what to do when faced with difficult decisions about whether to intervene or not. Andrew also advised attendees on the early actions that surgeons must take if a complaint is received and how best to manage the situation to reduce the risk of litigation. Andrew is a leading medical negligence barrister at Outer Temple Chambers and is regularly invited to provide training for RSM members.
