I recently updated operators that the Competition Appeal Tribunal had rejected DAFs application to appeal its decision to grant the Road Haulage Association (RHA) the first ever ‘opt in’ CPO which it granted in August this year. Despite indicating that they wish to settle, DAF have renewed their application to appeal the grant of the CPO. This process will drive in further costs and represents the latest attempt from DAF to delay access to justice for the 18,000+ businesses who originally signed up to the RHA’s legal action as a result of the truck cartel for which DAF and other major manufacturers were fined in excess of £3 billion for anti-competitive practices. The RHA and the legal team will continue to fight to achieve the best possible outcome for all those operators who opt in. As a reminder, if you historically joined the claim but have not taken any action to ‘opt in’ recently you will need to do so. Unless you have received an email confirming you are now opted into the claim at some point after 5 August 2024, then please get in touch and we will send you a new link to opt in.
