#Cybersecurity: Are we ready for the EU’s Cyber Resilence Act (CRA)? “The Act introduces greater responsibilities on manufacturers to guarantee the security of hardware and software products. Central to the Act are new obligations for manufacturers to provide software updates that fix security vulnerabilities and offer security support to consumers. By enhancing transparency on cyber risks and product security, the Act empowers consumers to make more informed choices about products available on the EU market.” “Products will bear the CE marking to indicate that they comply with the regulation's requirements. The main obligations of the Act will apply from 11 December 2027.” The Cyber Resilience Act complements the NIS2 cybersecurity framework, which entered into force last year. It is part of a series of comprehensive measures the EU is deploying to bolster the cybersecurity of an increasingly digital and connected Europe. Henna Virkkunen, European Commission Executive Vice-President, said: "We are committed to making Europe a safe and secure place for our citizens and businesses to operate. “Businesses do not have free rein to use fingerprinting as they please. Like all advertising technology, it must be deployed lawfully and transparently – if not the ICO will act.” NEW: We’ve published a blog from Stephen Almond, our Executive Director of Regulatory Risk, following Google’s announcement to organisations that use their advertising products, that from 16 February 2025, they will no longer prohibit them from employing fingerprinting techniques. Our view is that fingerprinting is an unfair means of tracking users online as it is likely to reduce people’s choice and control over how their information is collected. The change to Google’s policy means that fingerprinting could now replace the functions of third-party cookies. We’re continuing to engage with Google on this U-turn in its position and the departure it represents from our expectation of a privacy-friendly internet. How to assess your use of Artificial Intelligence with our data protection audit toolkit. We see new uses of artificial intelligence (AI) everyday, from healthcare to recruitment, to commerce and beyond. If used well, AI has the potential to make organisations more efficient, effective and innovative. However, AI also raises significant risks for people’s rights and freedoms and compliance challenges. Here are five things to consider this week to build data protection into your use of AI 🤖 Assign responsibility for general oversight of AI systems to a steering group, committee, meeting or equivalent. 🤖 Do you have a 'fall back' option, if human reviewers find an issue that questions the competency of the AI system? 🤖 Think about whether your AI system may influence other groups indirectly, or the possibility that not all people in the group will be impacted in the same way because of their different contexts. 🤖 Check that there is no imbalance in the training data used to train the system, such as over representation of one characteristic or group and that it is representative of the population. 🤖 Provide different explanations tailored to the intended audience that consider the level of knowledge that they have about the subject and are clear for them to understand.
