New Citizens Advice research has highlighted the staggering cost of failed IVAs. In our latest blog, Head of StepChange Subsidiaries, Sarah Cheetham, discusses the harm that unsuitable IVAs can cause to consumers. While a well-administered IVA can be hugely beneficial to certain people struggling with problem debt, patchwork regulation and limited consumer protections are causing widespread harm. In order to turn the tide on poor IVA outcomes, regulations around advice must be tightened, with a more consistent approach toward regulatory supervision. While the Financial Conduct Authority has made good progress in cracking down on predatory advertising, which inappropriately pushes people onto IVAs, online mis-selling is still rife. It will take a joint approach from IVA providers and regulators to better serve consumers and improve outcomes in the sector. Working with Luke Charters MP, we've written to Sarah Sackman as part of our campaign to see bailiffs regulated. As a charity on the frontline supporting those through arrears and debt, we know all too well the impact enforcement action has on the most vulnerable and we need to see the Government act on this as it is long overdue. Time and time again, our clients report heavy handed action which exacerbates their debt issues, rather than relieving them. Whilst the Enforcement Conduct Board has been a good starting point, the industry regulator needs a statutory footing, and only the Government can provide this. New StepChange research shows that nearly one in four UK adults – around 12.5 million people – are worried about their ability to pay their council tax bills over the coming months. Those who do fall behind on council tax all too often face punitive collection action. This shockingly includes a possible sanction of imprisonment for non-payment in England, under certain circumstances. Though rarely used in reality, this threat is often overemphasised, and enough to cause damaging consequences. What’s more, a number of people have been unlawfully imprisoned under this regulation. That’s why, alongside sector partners, we’ve written to Former Lord Chancellor David Gauke, who’s chairing an Independent Sentencing Review, urging him to set in motion plans to revoke this outdated sanction once and for all.
