Those keeping a watchful eye on the Civil Justice Council's review of the Pre-Action Protocols will have seen that the final part of their report was recently published, concluding the review. For those in the construction industry, you will be pleased to hear that the protocol for construction & engineering disputes will not see an overhaul as the CJC was "generally satisfied with it". The Landlord and Tenant Act 1954 – the bane of commercial property? I remember getting burned as a junior solicitor by making very minor amends to a lease on completion, but after the contracting out procedure was followed. The more senior ‘solicitor’ had skilfully tricked me which cost our client thousands of pounds and absolutely annihilated any confidence I had in my abilities as a lawyer. On the bright side, I’ve never made the same mistake again.
