Nathaniel Gadsby, an Associate Solicitor in our criminal defence team, has received a fabulous 5-star review from is client who he represented in a successful submission of ‘no case to answer’ in a death by dangerous driving case. Nathaniel’s client was the passenger in a vehicle that collided with another at excess speed, tragically killing the driver of the second vehicle. The driver pleaded guilty to causing death by dangerous driving and received a substantial custodial sentence, yet the Crown Prosecution Service insisted they would proceed with three charges against our client. Following an extensive legal argument, the Judge allowed a submission of 'no case to answer' at the close of the prosecution case, and the jury were discharged. Nathaniel was pleased to achieve such a positive outcome on a lengthy and complex case. Back at my desk today after spending part of last week at the ALC Conference in Bristol (and sharing a room with Maria Pilavaki!) Often attendance at these sorts of events can feel like something that is just reserved for more senior lawyers. I’m so grateful that TV Edwards Solicitors has supported me in attending the ALC Conference this year, despite still being in the early stages of my career as a solicitor. We began the day with a powerful keynote address from Lord Justice Peter Jackson, who paid tribute to four extraordinary women whose contributions to family law continue to resonate, even after their passing. Their commitment to radical change and humanity is a reminder for us as children’s lawyers to carry their legacy forward. Delegates also participated in performance art piece Bristol Cloud Burst—a shared moment of clapping at different intervals to mimic the sound of rain, transitioning into sunshine. A very beautiful and symbolic experience. With such an inspiring opening, the tone is set for an impactful conference. Shaun Livingston, an Associate lawyer in our leading Social Welfare team, has successfully secured an order for his client, declaring that the Article 8 ECHR rights of a significantly disabled child were breached by her local authority, Northumberland County Council (“NCC”), by unlawfully issuing care proceedings and requiring the child’s mother and siblings to leave the family home while the care proceedings were ongoing. The court’s order also records that changes made to the child’s bespoke care and education package while care proceedings were ongoing had a negative impact on her and caused her significant distress. A substantial damages settlement of £50,000 has also been agreed.
