I've had a number of clients previously approached by firms such as Atherton Corporate (UK) Ltd, offering a 'scheme' to walk away from their company debt. Luckily, following some sensible conversations, those clients opted for a legitimate insolvency process to wrap up the affairs of their companies, using us as licenced insolvency practitioners (IPs). Not only consulting with an IP is the correct process, it also mitigates the risk to directors of these insolvent companies. I fear that there maybe some comeback to those original directors caught up in schemes such as those which Atherton Corporate (UK) Ltd were offering; those directors also not acting in the best interests of the Company and Creditors as required under the Companies Act. Good to see that the Insolvency Service have taken further action against Neville Taylor in this case, but there are many more to be aware of.
