The Law Commission is reviewing Co-operative & Community Benefit Society law. Representatives from Wrigleys’ Charities and Social Economy Team have collaborated to respond to the consultation process. We are suggesting a new approach to how a Society is defined, which focusses on its purpose. The overall aim of our proposals is to make it easier for people to establish a purpose-based enterprise and to strengthen the role of members in its governance. This is a once-in-a-generation opportunity to shape the law and we are encouraging all Co-operative and Community Benefit Societies to share their views. Many community-led housing groups will be affected by the Law Commission’s current consultation on co-operative and community benefit societies. The law, largely unchanged since the 1850s, is due for an overhaul and Laura Moss, Partner at Wrigleys Solicitors, explores the impact of the proposed changes.
