Our CMS delegates returned home from Baku last weekend, following the end of COP29. Each day broached a new topic, from climate finance to the carbon footprint of the healthcare industry. But one theme remained constant – there is still more work to be done. A key question from Urbanisation, Transport and Tourism Day was – how can a circular economy approach transform the real estate and construction industry? The Court of Appeal has recently considered whether set-offs by an employer against amounts owed to a contractor counted towards an overall cap on liability. The Court found they did, but doesn't appear to have been referred to an earlier TCC decision which points the other way for recoveries under performance securities. The report provides a rigorous analysis of competition enforcement in the UK, analysing all 164 of the Competition and Markets Authority’s investigations and appeals to the Competition Appeal Tribunal since the early 2000s. During this podcast, two authors of the report (Neil Baylis and Lucy Charatan of CMS’ Antitrust Competition and Trade team), discuss the building and construction sector-specific highlights provided in the report. Contents of the podcast include: •Types of infringing behaviour seen in the building and construction industry;   •A consideration of whether the CMA has become more active in taking proceedings against directors in a personal capacity; and   •Lessons learnt from the report and trends to look out for in the future for the sector, including relating to ESG and labour markets.
