The High Court has ruled in favour of our client in his application for permission to proceed with a surrogacy arrangement using the last remaining embryo created with his late wife’s eggs, notwithstanding the fact that his wife had not provided written consent for such use. The application was brought in reliance on the European Convention on Human Rights (given effect in domestic law by the Human Rights Act 1998). This follows from the case of Jennings -v- Human Fertilisation and Embryology Authority [2022] EWHC 1619 (Fam), in 2022 in which our Life Sciences team also acted for the successful applicant. We're delighted to have advised Croydon-based Provide Community on the launch of Provide Equipment Hub, an employee-owned organisation dedicated to improving community access to essential equipment and support services. Commercial Health partner Jamie Foster led the multi-disciplinary team advising, supported on commercial matters by Robert McGough, Christiana Demetriou, Michael Ambrose-Howard, Alex Hollingsworth and Jasmyn Spanswick. Monica Macheng advised on corporate matters, James Atkins on property matters and Hed Amitai from the Private Client team advised on the employee ownership trust.
