In a recent article by The National Law Journal, Reed Smith's Thomas H. Suddath, Jr. shares his thoughts on Trump’s executive order, which called for Attorney General Pam Bondi to pause FCPA actions until DOJ issues revised enforcement guidelines regarding the statute. As Tom notes, Trump’s executive order applies exclusively to DOJ and not SEC FCPA enforcement, causing confusion for companies. #FCPA #Bribery #Regulatory #Enforcement “It’s created a lot of uncertainty among the defense bar and also companies about what the future of the FCPA enforcement looks like. There's a lot that is still unknown at this point.” - Tom Suddath

The US Securities and Exchange Commission recently requested more time to respond to a motion to dismiss one of the agency’s crypto enforcement cases, citing how its crypto task force could affect its approach in court. In a recent Cointelegraph article, Mark Bini shares his thoughts on this delay tactic: “It’s clear that the SEC is going to completely shift its enforcement activities as to crypto, and it makes sense that they would pause ongoing major actions like Binance while they await guidance from the SEC’s crypto task force. If the SEC now views most crypto as not being a security, those actions may be terminated entirely.” #crypto #enforcement #SEC
