Wisconsin man faces up to 27 years in prison for driving high from Marijuana

Wisconsin man faces up to 27 years in prison for driving high from Marijuana

On Thursday, Fond du Lac County District Attorney Eric J. Toney announced that Benjamin H. Ayer plead no contest to eight counts and was found guilty of: Intoxicated use of a Controlled Substance (marijuana) causing Great Bodily Harm, four counts of 2nd Degree Reckless Endangering Safety, Possession of Drug Paraphernalia, Possession of Tetrahydrocannabinols, and Operating while Intoxicated Causing Injury.

According to Toney, the defendant faces a maximum possible sentence of over 27 years of initial prison confinement.

Judge Andrew Christenson ordered a PSI and a sentencing date has been set for Feb. 4, 2025 at 1:30 p.m.

The state moved for bond be revoked and Judge Christenson revoked bond.

“We continue to see the dangers of marijuana on our roadways when someone drivers high. This defendant caused carnage inside a Verizon store when he was under the influence of marijuana and crashed his vehicle into the store, injuring customers and endangering the safety others. Thankfully nobody was killed but the emotional impact remains high for those inside the store and those whose family was impacted by the defendant’s dangerous actions,” Toney said.

This case was investigated by the City of Fond du Lac Police Department and prosecuted by Toney.
